Hermes, being first duly sworn upon oath, depose and say: '150, C, 1. They are the only children and the only heirs of Mable A. Hermes who died on November 11, 1996, and whose Last Will and Testament was admitted to probate in Case No. PR97 -23 in the County Court of Hall County, Nebraska. 2. As the Residuary beneficiaries of the Last Will and Testament of Mabel A. Hermes, they became the sole owners of the Mortgage filed for record as Document No. 92- 104703 in the office of the Register of Deeds of Hall County, Nebraska, against the real estate described as: Lot One (1) in Hermes Subdivision in the City of Grand Island, Nebraska, as surveyed, platted and recorded, subject to an easement over the Westerly Twenty feet (20') for ingress and egress of motor vehicles to and from Lots Two (2) and Three (3) in Hermes Subdivision in the City of Grand Island, Nebraska, as surveyed, platted and recorded, and the Promissory Note which that Mortgage secures. 3. Each of them has been the continuous owner of his and her one -third ('-�) interests since the death of their mother, each is now the owner of an undivided one -third (,) interest in the above described Note and Mortgage and no other person has any right, title, claim or interest therein or thereto. 4. For valuable consideration the receipt whereof is hereby acknowledged by each of them, the undersigned, Ann Rosenblatt and Frank Hermes, do each hereby grant and assign to Mary Jane Lee their one -third (1-5) interests in the above described Note and Mortgage, hereby declare that Mary Jane Lee is the sole owner of each of those documents and warrant that 1
