E woldt, a single p erson, G RANTOR, in consideration of one dollar and <br />other valuable consideration received from GRANTEE, Husker Retail Development, LLC, a <br />Nebraska Limited Liability Company, conveys to GRANTEE, the following described real <br />estate (as defined in Neb. Rev. Stat.76 -201): <br />See Exhibit "A" attached hereto and by this reference made a part hereof. <br />GRANTOR covenants (jointly and severally, if more than one) with GRANTEE that <br />GRANTOR: <br />(1) is lawfully seized of such real estate and that it is free from encumbrances, <br />except for any easements and restrictions now of record; Lamar and Indianhead <br />leases, claims of adverse possession by Theodore J. Robb and those <br />encroachments as disclosed on the survey prepared by Olsson Associates, dated <br />June 30, 2005; <br />(2) has legal power and lawful authority to convey the same; and <br />(3) warrants and will defend title to the real estate against the lawful claims of all <br />persons. <br />Executed on this Ath day of July , 2005. <br />Velma M.
