THIS DECLARATION OF EASEMENTS is made as of the 2y day of
<br />tuE , 2005, by GRAND ISLAND PARTNERSHIP 11, a Tennessee general
<br />partnership ( "Declarant ").
<br />WITNESSETH:
<br />WHEREAS, Declarant is the fee simple owner of Lot 6, Block 1 ( "Lot 611), Lot 5,
<br />Block 1 ( "Lot 5 ") and Outlot B ( "Outlot B "), of Wal -Mart South Subdivision to the City
<br />of Grand Island, Hall County, Nebraska, as shown on the plat (the "Plat ") recorded July
<br />13, 2004, as Document No. 200406865, in the Office of the Register of Deeds of Hall
<br />County, Nebraska.
<br />WHEREAS, Declarant desires to impose certain easements upon Lot 6 and
<br />Outlot B for benefit of Lot 5, the owner of Lot 5 and its successors and assigns, on the
<br />terms and conditions set forth herein.
<br />NOW, THEREFORE, for and in consideration of the premises, easements and
<br />encumbrances contained herein, the sufficiency of which is hereby acknowledged, the
<br />Declarant does hereby declare that Lot 6 and Outlot B shall be and are hereby subject to
<br />the terms, easements and conditions hereinafter set forth in this Declaration and in
<br />connection therewith, the Declarant covenants and agrees as follows:
