CONSENT TO ASSIGNMENT <br />WHEREAS. Kuester Lake, Inc., hereinafter called "owner" has leased to <br />Kent C. Orr and Dianna L. Orr, husband and wife, certain property described as: ?� S <br />Lot Twenty (20) on the West side of the West portion of Kuester Lake <br />located in the East Half of the Southwest Quarter (E1 /2SW1/4) of Section <br />13, Township 11 North, Range 9, West of the 6th P.M., in Hall County, <br />Nebraska. <br />and said lessee is desirous of assigning to First Security Bank, Cozad, Nebraska, <br />lessee interest In said lease, as stated in the Assignment, and <br />WHEREAS, it is necessary under said Lease Agreement to procure the <br />consent of such assignment, <br />NOW THEREFORE, in consideration of the premises, owner does hereby <br />consent to the assignment of said lease for the purposes set forth in said <br />assignment, subject to the terms of said lease and upon the following additional <br />conditions or terms: <br />1. The consent given applies only to the rights of a tenant in said lease. <br />The assignor is not released from his obligations to the lease. <br />2. The assignee shall not acquire any greater rights, or interest, in the <br />premises as against and its title and possession than the assignor has or had by <br />the terms of said lease. <br />3. Said assignee may file a financing statement or other statement of <br />encumbrance with the Register of Deed for Hall County, Nebraska, if the same <br />purports to claim only an interest in the personal property and lease rights of the <br />lessee and if the same has attached to it this Assignment and Consent to <br />Assignment.
