As used herein the following phrases mean: <br />A. Yankten Property means the East Half of the <br />Southwest Quarter (E'-�SWI4) of Section Seventeen (17), Township <br />Twelve (12) North, Range Nine (9), West of the 6th P.M., Hall <br />County, Nebraska. <br />B. Kruse Property means the West Half of the <br />Southwest Quarter (W-�SW3'a) of Section Seventeen (17), Township <br />Twelve (12) North, Range Nine (9), West of the 6th P.M., Hall <br />County, Nebraska. <br />2. Betty A. Yankten is the owner of the Yankten Property. <br />Ima ,lean Kruse and Daniel Kruse and Donna Kruse are the owners <br />of the Kruse property and are hereinafter referred to, jointly <br />and severally, as The Kruses. <br />3. Along and upon the north edge of the Kruse Property an <br />unimproved dirt driveway runs east and west, which is hereafter <br />referred to as the Kruse Driveway. <br />4. The Kruses hereby grant to Betty A. Yankten and her <br />tenants the non - exclusive right to use the Kruse Driveway for <br />ingress and egress to the Yankten Property by farm trucks, <br />machinery and equipment. And, in the event that the bridge <br />connecting the Yankten Property to the County Road to its south <br />should become unusable, Betty A. Yankten may use the Kruse <br />Driveway for ingress and egress to her residence by automobiles. <br />Tn making the allowable use of the Kruse Driveway, Betty A. <br />Yankten and her tenants must stay upon the driveway and must <br />repair or pay for any damage to the crops growing on the Kruse <br />Property as well as any costs of repairing the hills in which <br />corn is grown on the Kruse Property if those hills are flattened <br />by the automobiles, trucks, machinery or equipment of Betty A. <br />Yankten or her tenants or anyone else claiming the right to use <br />the Kruse Property through permission of Betty A. Yankten. <br />1 <br />
