<br />This instrument, made this day of June, 2005, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor ", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on December 28, 2001 as Instrument
<br />No. 0200113486 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, and Federal Home Loan Mortgage Corporation, hereinafter called "Grantee ":
<br />WHEREAS, on April 5, 2005, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Ernest F. Bane, Jr. and Nadine Bane, husband and
<br />wife, Trustors, under that certain Deed of Trust recorded on December 28, 2001 as Instrument No.
<br />0200113486 of the Mortgage Records in the office of the Register of Deeds of Hall County,
<br />Nebraska, covering that certain premises described as:
<br />S '/z OF LOT 1 & S '/2 OF E '/2 OF LOT 2, BLOCK 4, BRETT & JOHNSON
<br />ADDITION, CITY OF WOOD RIVER, HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on April 7, 2005 as Instrument No. 0200503055 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on May 13, 2005, Grantor caused to be published in the
<br />Grand Island Daily Independent, a newspaper having a general circulation in Hall County,
<br />Nebraska, a Notice of Trustee's Sale setting forth a description of the property to be sold and stating
<br />that the described property would be sold at public auction to the highest bidder for cash or certified
<br />or cashier's check, at the lower level lobby of the Hall County Courthouse, 1St & Locust Street,
<br />Grand Island, Hall County, Nebraska, at 10:00 a.m. on June 23, 2005. Publication of such notice
<br />was made for five consecutive weeks on May 13, 2005, May 20, 2005, May 27, 2005, June 3, 2005
<br />and June 10, 2005, the last publication being at least ten (10) days but not more than thirty (30) days
<br />prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's
<br />Sale, offer said property for sale at public auction, and did sell the same to Wells Fargo Bank,
<br />N.A., successor by merger to Wells Fargo Home Mortgage, Inc. for the sum of $35,000.00, it
<br />being the highest bidder therefor. Wells Fargo Bank, N.A., successor by merger to Wells Fargo
<br />Home Mortgage, Inc. has assigned all of its right, title, and interest in and to such bid to Grantee.
