This Deed of Trust was recorded November 10, 1994 in the <br />Records of the Register of Deeds of Hall County, Nebraska as Instrument No. 94109095. The Deed of <br />Trust was re -filed on November 22, 1994 as Instrument Number 94- 109349. <br />On or about November 10, 1994, Home Federal Savings and Loan Association of Grand Island, <br />Beneficiary, assigned all of its right, title and beneficial interest in the Deed of Trust to Commercial <br />Federal Mortgage Corporation. The Assignment was recorded November 10, 1994, in the office of the <br />Register of Deeds of Hall County, Nebraska, as Instrument No. 94- 109096. The Assignment was re- <br />filed on December 5, 1994, as Instrument Number 94- 109643. <br />Hereinafter the Trustee, Commercial Federal Bank, a Federal Savings Bank, will be referred to <br />as GRANTOR. <br />The GRANTOR in consideration of Fifty -Six Thousand Four Hundred Five Dollars and <br />Fifty -One Cents ($56,405.51) and other valuable consideration received from Commercial Federal <br />Bank, a Federal Savings Bank, successor to Commercial Federal Mortgage Corporation, <br />hereinafter GRANTEE, does hereby grant, bargain, sell, convey and confirm unto GRANTEE the <br />following described real property in Hall County, Nebraska: <br />All of Lot Thirty Eight (38) and the East Thirty Five feet (E35') of Lot Thirty Seven <br />(37), Block Three (3), Blain Addition, City of Grand Island, Hall County, Nebraska <br />except a tract of land deeded to the City of Grand Island by Quitclaim Deed recorded <br />in Book 141 at Page 281 of the Deed Records of Hall County, Nebraska <br />To have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereto belonging unto the GRANTEE, and to the GRANTEE'S successors and assigns <br />forever. <br />GRANTOR does hereby covenant with the GRANTEE and with the GRANTEE'S successors <br />and assigns: <br />(1) That Toan Van Nguyen and Lai Bich Tbi Le, as husband and wife, as Trustors, failed to <br />pay the Beneficiary payments which were contractually due, and the GRANTOR, at the request of the <br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest thereon, at once <br />immediately due and payable. <br />(2) That a Notice of Default was recorded by GRANTOR on January 18, 2005, as Instrument <br />No. 200500458, in the records of the Register of Deeds, Hall County, Nebraska. Within ten (10) days <br />thereafter, a copy of the recorded Notice of Default was mailed by certified mail, postage prepaid, to all <br />parties entitled to notice, pursuant to said Deed of Trust and in compliance with Neb. Rev. Stat. § 76- <br />1008 (Reissue 2003). <br />(3) That Trustors, Toan Van Nguyen and Lai Bich Thi Le, as husband and wife, failed to <br />cure the default referenced in the Notice of Default within 30 days after the recording of the Notice of <br />Default. <br />
