a. Any Dwelling consisting of one level above ground shall have <br />a minimum of one thousand five hundred (1,500) square feet of living area <br />on the first level, which shall be above ground. Dwellings must have <br />basements. <br />b. Any Dwelling, consisting of a two -story design, shall have a <br />minimum of one thousand one hundred (1,100) square feet of living area on <br />the ground floor, not including the garage. <br />C. The minimum liveable square footage of any split -level or split - <br />foyer type Dwelling shall be above ground level and the finished sub- <br />basement of the Dwelling shall not be included in computing the minimum <br />liveable square footage. <br />13. Vegetation /Landscaping. The Owner of each Lot shall keep the vegetation <br />and grass thereon cut to a height less than eight (8) inches, and prior to construction, an <br />Owner shall mow or cut all weeds and grass on their Lot and keep the vegetation to a <br />height less than eight (8) inches. There shall be no cottonwood trees planted. Grass <br />should be planted for lawns, and rock allowed for landscaping. Each lawn shall be irrigated <br />by an underground sprinkler system. All landscaping plans shall be prior approved by the <br />Architectural Committee or Board of Directors. <br />14. Real Estate Taxes. Any real estate taxes levied and assessed against <br />Bellamy's Subdivision Homeowners Association shall be borne equally and paid by the <br />members of the Bellamy's Subdivision Homeowners Association through Annual <br />Assessments as described in Article III, paragraph 4. <br />ARTICLE III <br />ORGANIZATION OF ASSOCIATION <br />1. Formation of Association. The Bellamy's Subdivision Homeowners <br />Association is a non- profit Nebraska corporation charged with the duties and vested with <br />the powers prescribed by law and set forth in the Articles, Bylaws, and this Declaration. <br />Neither the Articles or Bylaws shall, for any reason, be amended or otherwise changed or <br />interpreted so as to be inconsistent with this Declaration.
