<br />Covenants, Restrictions, and Conditions
<br />THIS AGREEMENT is entered into on this c day of _��,�,h� - -, 2005, by and among
<br />McNelis Development, L.L.C., a Nebraska Limited Liability Company (hereinafter
<br />referred to as Declarants) and Melvin E. Zichek and Dorothy V. Zichek, Husband and
<br />Wife, Declarants and Owners (hereinafter referred to as Owner). Declarants and Owner
<br />agree to the following:
<br />DECLARATION OF PURPOSE
<br />Declarants are the owners of real property in the County of Hall, State of
<br />Nebraska, which is more particularly described as:
<br />Northview First Subdivision, in the City of Grand Island, Hall County, Nebraska,
<br />according to the recorded plat thereof, EXCEPT Block One (1), AND EXCEPT Lot One
<br />(1) of Block Three (3) thereof.
<br />Which is in tract of land located in the:
<br />WHEREAS, Declarants desire to provide for the construction of a planned
<br />residential area consisting of single family residences, including without limitation open
<br />spaces and recreational facilities; and
<br />WHEREAS, Declarants hereby declare that the lots of the property described
<br />above, shall be held, sold and conveyed subject to the following reservations, easements,
<br />limitations, restrictions, servitudes, covenants, conditions, charges and liens (hereafter
<br />collectively termed "covenants and restrictions" which are for the purpose of protecting
<br />the value and desirability of Northview First Subdivision, in the City of Grand Island,
<br />Hall County, Nebraska, according to the recorded plat thereof, EXCEPT Block One (1),
<br />AND EXCEPT Lot One (1) of Block Three (3) thereof and which shall run with the real
<br />property and be binding on all parties having any right, title or interest in one of the
<br />described lots, or any part thereof, their heirs, successors, assigns, and personal
<br />representatives, and which shall inure to the benefit of each Owner thereof.
