AMENDED MASTER DEED AND DECLARATION <br />This Master Deed and Declaration, is made by Thayer Family, L.L.C., a Nebraska Limited <br />Liability Company, hereinafter referred to as the Declarant. <br />ARTICLE I. PURPOSE AND NAME <br />The purpose of this Master Deed and Declaration is to submit land herein described and <br />improvements built thereon to the condominium form of ownership and use in the manner provided <br />by the Nebraska Condominium Act. The name by which this condominium is to be identified is <br />The Village Condominiums, a condominium. The name of the association shall be the Village <br />Condominium Unit Owners Association, Inc., a non - profit corporation. <br />ARTICLE II. INVOLVED PROPERTY <br />The land which has previously been submitted is described as follows: <br />Lot One (1), The Village Third Subdivision to the City of Grand Island, Hall County, <br />Nebraska. <br />The land being submitted to the condominium is described as follows: <br />Lot Six (6), Units Fifteen (15) and Sixteen (16), The Village Third Subdivision to the City <br />of Grand Island, Hall County, Nebraska. <br />ARTICLE III. NUMBER OF UNITS <br />The total number if units created shall be seventy nine (79), plus a clubhouse. The <br />number of units to be created initially is two (2), and by the exercise of special declarant rights, this <br />document reserves the right to add an additional seventy -seven (77) units and clubhouse, and <br />reserves the right to add additional land or lots being Lots Two (2) through Twenty -nine (29), <br />inclusive, Village Third Subdivision to the City of Grand Island, Hall County, Nebraska, which <br />shall be accomplished by amending this Master Deed and Declaration. <br />ARTICLE IV. BOUNDARIES <br />The boundaries of each unit, including the unit's identifying number, are shown on <br />Exhibit 'W', (plat and plan). The boundaries are the unfinished surface of the outer most interior <br />walls, fireplace openings, if any, up to the flue in the closed position, the unfinished surface of the <br />ceiling immediately below the roof as indicated for each separate unit upon the attached Exhibit <br />"A" and the extension of those surfaces where the unit includes unenclosed space. <br />ARTICLE V. COMMON ELEMENTS <br />The common elements are all portions of the condominium other than the units.
