SCHEDULE A 200505622 <br />to <br />Secured Promissory Note No. 18963 -101 <br />dated _ �, 2005 <br />between Irwin Franchise Capital Corporation, as Holder <br />and RT Omaha Franchise, LLC, as Maker <br />All right, title and interest of Maker now owned, or hereafter acquired, in and to the following <br />property, rights and interests (such property, rights and interests being hereinafter collectively <br />referred to as the "Mortgaged Property"): <br />(a) all machinery, apparatus, equipment, fittings, fixtures and other property <br />of every kind and nature whatsoever owned by Maker, or in which Maker <br />has or shall have an interest, now or hereafter located upon. the Mortgaged <br />Property, or appurtenances thereto, or usable in connection with the <br />present or future operation and occupancy of the Mortgaged Property and <br />all building equipment, materials and supplies of any nature whatsoever <br />owned by Maker, or in which Maker has or shall have an interest, now or <br />hereafter located upon the Mortgaged Property (hereinafter collectively <br />referred to as the "Equipment"); <br />(b) all proceeds of and any unearned premiums on any insurance policies <br />(collectively, hereinafter referred to as the "Policies ") covering the <br />Mortgaged Property, including, without limitation, the right to receive and <br />apply the proceeds of any insurance, judgments, or settlements made in <br />lieu thereof, for damage to the Mortgaged Property; <br />(c) all additions, substitutions and replacements arising out of, in connection <br />with, or otherwise related to the collateral described in the foregoing <br />subsections (a) through (b) together with all interest, income, dividends, <br />distributions and earnings thereon and /or other monies or revenues derived <br />therefrom; and <br />(d) all products and proceeds of each of the foregoing. <br />COLLATERAL LOCATION: Eagle Run Shopping Center <br />U.S. 281 and West 13`h Street <br />Grand Island, NE <br />LEGAL DESCRIPTION: See Exhibit A <br />PAYMENT TERMS: See Secured Promissory Note No. 18963101 <br />ADDITIONAL PROVISIONS: See Cross - Default and Cross- Collateralization Rider of even <br />date herewith and Prepayment Rider which is attached hereto and dated this date. <br />51 <br />CL,T 837345vi <br />
