200505434 <br />DURABLE POWER OF ATTORNEY <br />NOT AFFECTED BY DISABILITY <br />Know all men by these presents that I, Mary Eldene Nelson, <br />of Grand Island, Nebraska, hereby revoke all powers of attorney <br />made by me previously and hereby make, constitute and appoint my <br />daughter, Jill L. Davis, Lincoln, Nebraska, as my true and <br />lawful attorney -in -fact to act in my name, place and stead. <br />I give my attorney -in -fact the fullest powers possible and <br />grant her the authority to perform any and every act, deed, <br />matter, and thing whatsoever in and about my estate, property <br />and affairs, as fully and effP�:_ta_vel.y__ as I m.ight.. or .could do if <br />personally present and acting, including the power to sell, <br />convey and mortgage real estate. I specifically include in this <br />authority a grant of "plenary power ", as those words are used in <br />the Nebraska Short Form Act, Section 49 -1501 et seq., Nebraska <br />Revised Statutes. I promise, furthermore, to ratify all that my <br />attorney -in -fact shall lawfully do or cause to be done by virtue <br />of this power. <br />It is further provided that: <br />1. Pursuant to the provisions of the Nebraska Probate <br />Code, I declare that this power of attorney shall not be <br />affected by my disability or incapacity, and that the authority <br />granted herein shall continue during any period while I am <br />disabled or incapacitated. Further, pursuant to said sections, <br />all such authority shall continue after my death, until notice <br />of such death shall have been received by my attorney -in -fact so <br />that she has actual knowledge of the fact that I have died. Any <br />action taken in good faith by said attorney -in -fact during any <br />period while it is uncertain whether I am alive, before she <br />receives actual knowledge of my death, or, in any event, taken <br />during any period while I am disabled or incapacitated, shall be <br />as valid as if I were alive, competent, and not disabled. <br />2. Pursuant to Nebraska Probate Code Sections 30 -2627 and <br />30 -2639 and in the event appointment of a guardian and <br />conservator becomes necessary because of my disability or <br />incapacity, I nominate Jill L. Davis to be my guardian and <br />conservator. <br />3. Tax Powers. This Power of Attorney also grants to the <br />attorney -in -fact authority to prepare, sign and file joint or <br />separate income tax returns or declarations of estimated tax for <br />any year or years; to prepare, sign and file gift tax returns <br />with respect to gifts made by me for any year or years; to <br />consent to any gift and to utilize any gift - splitting provisions <br />or other tax election; and to prepare, sign and file any claims <br />for refund of any tax; <br />
