<br />James L. Harder, President, Diamond Engineering Co., being first duly sworn upon oath, deposes
<br />and says:
<br />Your affiant is the President of Diamond Engineering Co.(hereafter "TDECO ") and as said
<br />officer verifies this account in writing for and on behalf of himself, TDECO and the City of Grand
<br />Island Water and Sewer Districts,
<br />2. Your affiant d/b /a TDECO entered into a written contract with Gary Valasek for labor and
<br />materials relating to Water Main District 443 and 447 T, and Sanitary Sewer District 510 and 514,
<br />work in connection with and located on the real estate hereinafter described, American
<br />Independence Subdivision Area.
<br />3. Said TDECO entered into this contract as the purchaser of the real estate on which the
<br />contracted and specific work was to be done.
<br />4. The labor and materials were provided on the real estate legally described as follows:
<br />A tract of land comprising all of Lots One (1), Two (2), Five (5), Six (6), Seven (7),
<br />Eight (8), Nine (9), Ten (10), Eleven (11), Twelve (12), Thirteen (13), Fourteen (14),
<br />Fifteen (15), Sixteen (16), Seventeen (17), Eighteen (18), Nineteen (19), Twenty (20),
<br />and Twenty -one (21), American Independence Subdivision, in the City of Grand
<br />Island, Hall County, Nebraska.
<br />—AND --
<br />A tract of land comprising all of Lots Three (3) and Four (4), American
<br />Independence Subdivision, in the City of Grand Island, Hall County Nebraska said
<br />tract containing 0.666 acres more or less.
<br />Thereafter designated as "American Independence Second Subdivision;' Lots One'(1) and Two (2) .
<br />The date when materials or services were last furnished to said property was on or about March
<br />21, 2005 and ongoing per City Specifications, and the price for these services was Six Thousand
<br />Seven Hundred Fifty and ` /100 Dollars ($6,750.00).
<br />6. TDECO claims a lien on the above - described real estate for the full amount of the account due
<br />of Six Thousand Seven Hundred Fifty and ` /,00 Dollars ($6,750.00) together with interest thereon
<br />at the legal rate as allowed and provided by law, from and after September 22, 2004 (See,
<br />attached Exhibit "A ", TDECO Proposal; Exhibit "B" American Independence Specifications
<br />Face Sheet, City of Grand Island, Grand Island Nebraska.
