200504511 <br />ADJUSTABLE RATE RIDER <br />THIS ADJUSTABLE RATE RIDER is made this 25th day of April 1 2005 and is <br />incorporated into and shall be deemed to amend and supplement the Mortgage, Deed of Trust, or Security Deed (the <br />"Security Instrument ") of the same date given by the undersigned (the "Borrower ") to secure Borrower's Adjustable Rate <br />Note (the "Note ") to FCE Credit Union <br />(the "Lender ") of the same date and covering the property <br />described in the Security Instrument and located at: <br />4005 Norseman Ave. Grand Island, NE 68803 <br />[Property Address] <br />THE NOTE CONTAINS PROVISIONS ALLOWING FOR CHANGES IN THE <br />INTEREST RATE AND THE SCHEDULED PAYMENT. THE NOTE DOES NOT <br />LIMIT THE AMOUNT THE BORROWER'S INTERESTRATE CAN CHANGE AT <br />ANY ONE TIME. THE NOTE LIMITS THE MAXIMUM RATE THE BORROWER <br />MAY PAY. <br />ADDITIONAL COVENANTS. In addition to the covenants and agreements made in the Security Instrument, <br />Borrower and Lender further covenant and agree as follows: <br />A. INTEREST RATE AND SCHEDULED PAYMENT CHANGES <br />The Note provides for an initial interest rate of 6.700 %. The Note provides for changes in the interest rate <br />and the scheduled payments as follows: <br />1. INTEREST RATE AND PAYMENT CHANGES <br />(A) Change Dates <br />The interest rate 1 will pay may change on the first day of _ April 2010 , and on the first day of <br />every month thereafter. Each date on which my interest rate could change is called a "Change Date." <br />(B) Variable Interest Rate <br />The interest rate on this Note is subject to change from time to time based on changes in an index, which is <br />the rate set at the sole discretion of the credit union board of directors. The Rate is not indexed, either internallyor externally <br />(the "Index "). The Index is not necessarily the lowest rate charged by Lender on its loans and is set by Lender in its sole <br />discretion. If the Index becomes unavailable during the term of this loan, Lender may designate a substitute Index after <br />notifying me. Lender will tell me the current Index rate upon my request. I understand that Lender may make loans based on <br />other rates as well. The interest rate change will not occur more often than each month. The Index currently is <br />6.700 % per annum. The interest rate to be applied to the unpaid principal balance of this Note will be at a rate <br />equal to the Index, adjusted if necessary for the maximum rate limitation described below, resulting in an initial rate of <br />_ 6.700 % per annum. Notwithstanding any other provision ofthis Note, the variable interest rate or rates provided <br />for in this note will be subject to the following maximum rate. On each Change Date occurring under this Note, the interest <br />rate will change. The interest rate to be applied to the unpaid principal balance as of the Change Date will be at a rate equal <br />to the Index for such Change Date, adjusted if necessary for the maximum rate limitation described below. This interest rate <br />will become my new interest rate. Lender will then determine the scheduled payment amount, calculated at the new interest <br />rate and in substantially equal payments that would be sufficient to repay the unpaid principal, as of the Change Date, that I <br />am expected to owe on the Maturity Date. The result of this calculation will be the amount of my new scheduled payment <br />Unless waived by Lender, any increase in the interest rate will increase the amounts of my payments. <br />(C) Limits on Interest Rate Changes <br />The maximum interest rate that can apply under this Note is 18.000 %, or the maximum Annual Percentage <br />Rate allowed by applicable law, whichever is less. Apart from this "cap ", there is no limit on the amount by which the rate <br />can change. <br />(D) Effective Date of Changes <br />My new interest rate will become effective on each Change Date.
