Persons Subiect to Restrictions; Modifications, These covenants, restrictions and conditions are to run with the land and shall be binding upon all persons and all parties claiming ownership of lots for a term of thirty (30) years from the date this Agreement is recorded after which time it shall be automatically extended for successive periods of ten (10) years. This Agreement may be amended, or a variance granted, during the first ten (10) year period by an instrument signed by at least two - thirds (2/3) of the Class A members, and one hundred percent (100 %) of the Class B members, and thereafter by an instrument signed by at least fifty percent (50 %) of the Class A members and one hundred percent (1001/6) of the Class B members. Any amendment to this Agreement must be recorded with the Register of Deeds of Hall County, Nebraska. 11. Enlargement of Association Membership; Merger of Associations. If at such time, the Declarant shall subdivide additional land, currently owned by the Declarant and adjacent to the Hoffman Second Subdivision, the Declarant shall require and impose these same covenants and any amendments thereto, to any subsequent subdivisions. It shall also be required of all members and owners of lots in the original Hoffman Second Subdivision, and any subsequent phases of the Hoffman Second Subdivision, to accept without objection, all new members and owners of lots in any new or future subdivisions created by the Declarant, his successors, or assigns. All lot owners in any new subdivisions created by the Declarant shall be members of the Hoffman Subdivision Homeowners Association with the same rights, privileges, responsibilities accorded to any original member of the Association.
