200502917 <br />upon, over and across the SW'/NW'/NW' /4 of Section 26, Township <br />12 North, Range 11 West of the 6th P.M., Hall County, NE, lying <br />between two lines drawn parallel with and distant, respectively, 50.0 <br />feet and 100.0 feet Northeasterly, as measured at right angles from <br />said Main Tract centerline, bounded on the South and West by the <br />South and West lines of said SWY4NWY4NW' /, and containing 0.39 <br />acres, more or less. <br />The South Half of the Northwest Quarter (S %NW %), Section Thirty-six (36), <br />Township Twelve (12) North, Range Eleven (11) West of the 6th P.M., Hall <br />County, NE, excepting therefrom a tract of land more particularly described <br />as: <br />A tract of land located in part of the South Half of the Northwest <br />Quarter, of Section 36, Township 12 North, Range 11 West of the 6th <br />P.M., Hall County, NE, described as follows: <br />Referring to the Southeast corner of said Quarter Section; thence <br />Northerly a distance of 668.85 feet along the East line of said <br />S' /2NW% to the Point of Beginning; thence Northerly deflecting <br />00 °00'00" a distance of 42.92 feet along said line; thence <br />Northwesterly deflecting 54 037'32" left, a distance of 579.06 feet along <br />the Southwesterly existing Highway 2 right of way line; thence <br />Southwesterly deflecting 94 022'44" left, a distance of 45.13 feet along <br />the West line of the property owned by the Grantor(s); thence <br />Southeasterly deflecting 86 °34'30" left, a distance of 600.55 feet to the <br />Point of Beginning containing 0.54 acres, more or less. <br />There will be no ingress or egress over the above - described tract from <br />or to the remainder of said South Half of the Northwest Quarter, <br />except, over one conditional restricted access(es), such access is to <br />be permitted only if it does not exceed 40 feet in width, and only so <br />long as traffic upon such access(es) does not exceed 10 vehicle <br />movements per hour as determined by the Department of Roads in <br />accordance with the procedures indicated below. The centerline(s) of <br />the access(es) (is, are) located northwest 488.59 feet from the East <br />line of said South half of the Northwest Quarter as measured along <br />the centerline of the highway. <br />For the purpose of this instrument, the 10 vehicle movements per hour <br />will be measured and determined by the following procedure: upon its <br />own determination or whenever traffic congestion occurs at a <br />restricted access, the Department may make a traffic count, such <br />count to be for a minimum 8 -hour period during the hours of 7 AM to 9 <br />AM, 10 AM to 1 PM, 3 PM to 6 PM, and, in addition, for any other <br />peak hours peculiar to the Highway. The average hourly traffic will be <br />determined by dividing the total number of vehicle movements <br />recorded during the time periods by the length of the time periods in <br />hours. In the event any of the peak hour vehicle counts exceeds the <br />average by a factor of 1.5, the higher figure may be used to determine <br />the number of vehicle movements for the access point. <br />A tract of land comprising a part of the North Half of the Northwest Quarter <br />(NY2NW %) and part of the Northwest Quarter of the Northeast Quarter <br />
