McGuire, being first duly sworn upon oath, deposes and states as follows: 1. That the Affiant is the surviving spouse of Francis Morris McGuire, a /k /a F. Morris McGuire, who died July 31, 1998, as shown by the Certified Copy of the Death Certificate attached hereto as Exhibit "A" and incorporated herein by this reference; that the Affiant and the Decedent, F. Morris McGuire, were husband and wife on the date of Decedent's death on July 31, 1998. 2. That on said date of death, the Affiant and Decedent were the sole owners as joint tenants with rights of survivorship of the real estate legally described as follows: The South Half of the Southeast Quarter (S1 /2 SE1 /4) of Section Twenty -Two (22), consisting of 80 acres more or less, and that part of the Northeast Quarter (NE1 /4) of Section Twenty -Seven (27) lying North of the gravel county road running diagonally through the Northeast Quarter (NE1 /4) and known as "Old Military Road ", consisting of 76.24 acres, all in Township Ten (10) North, Range Twelve (12), West of the 6th P.M., in Hall County, Nebraska. 3. That by virtue of the survivorship of the Affiant, Affiant became the sole owner of the above - described property. 4. This Affidavit is given as evidence that pursuant to R.R.S. Neb. § 77 -2003, no inheritance tax lien arising due to the death of the Decedent can attach to the above - described real estate and that pursuant to § 77 -2012, R.R.S.
