Box 987 <br />Hastings, NE 68902 -0987 <br />CONSENT TO USE <br />C-> cr <br />C Ty <br />� m <br />-�. rn <br />m <br />v> <br />n <br />�n <br />cn <br />THIS CONSENT TO USE (this " Consent ") is hereby made and entered into as of this <br />i° day of March, 2005, by ALLEN PHASE III LLC, a Nebraska limited liability company <br />( "Declarant "). <br />Declarant executed a certain ECR Declaration dated December 10, 2003, and recorded <br />December 17, 2003 as Instrument No. 0200316111, in the official records of Hall County, <br />Nebraska (the "Declaration ") which creates certain easements and restrictions affecting Lot 14, <br />Meadowlark West Fourth Subdivision, a subdivision, as surveyed, platted and recorded in Hall <br />County, Nebraska ( "Lot 14 "). <br />Declarant desires to permit a use with respect to Lot 14 which is otherwise restricted by <br />Section 3 (xvii) of the Declaration. <br />TERMS AND CONDITIONS <br />NOW, THEREFORE, in consideration of the foregoing Preliminary Statement, which <br />by this reference is repeated and incorporated in this portion of this Amendment in its entirety, <br />and for a good and valuable consideration, the receipt and sufficiency of which are hereby <br />acknowledged, Declarant establishes the following: <br />1. Permitted Use for Lot 14.
