<br />LICENSE AGREEMENT
<br />This License Agreement is made by and between the CITY OF GRAND ISLAND,
<br />NEBRASKA, a Municipal. Corporation, herein referred to as the "Licensor" and ROBERT E.
<br />RASHER and ERMA JENE RASHER, husband and wife, as owners, hereinafter referred to as
<br />the "Licensees" and GEOTECHNICAL SERVICES, INC., as contractor.
<br />1. STATEMENT OF PURPOSE. The purpose of this License Agreement is to set
<br />forth the terms and conditions under which Geotechnical Services, Inc., as contractor, may
<br />construct, maintain, repair, and utilize the following described improvement which will infringe
<br />upon right -of -way held by the Licensor on property owned by the Licensees:
<br />Placement of a monitoring well by Geotechnical Services, Inc. (GSI) in the City's
<br />right of way between the sidewalk and North Sycamore Street at 123 East 5t"
<br />Street in Grand Island, Nebraska as shown on the attached drawing. Said
<br />monitoring well shall be flush with surrounding property.
<br />The exact placement of such monitoring well on the property identified above
<br />shall be coordinated with the Licensor's Public Works Department.
<br />The legal description of the property adjacent to where the monitoring well will
<br />be installed is the north 89 feet of the east 44 feet of Lot 1, and the north 96 feet
<br />of the west 22 feet of Lot 1, Block 30, Original Town, now known as the City of
<br />Grand Island, Hall County, Nebraska.
<br />2. CONTRACTOR'S DUTIES AND RISKS. It is understood and agreed that
<br />Geotechnical Services, Inc. may construct, maintain, repair and utilize the above described
<br />improvement at Geotechnical Services, Inc.'s sole risk. The contractor hereby waives any claim
<br />for damages against the Licensor, its officers, employees, agents and independent contractors for
<br />any damage or injury that may result to said improvement. If the Licensor, in its sole discretion,
<br />determines that any part or all of the improvement must be removed or is damaged by the
<br />Licensor, its employees, agents or independent contractors working for the Licensor during the
