T1 <br />200502094 C] <br />WATER WELL AGREEMENT <br />This Agreement is made and entered into this , : day of off, 2004 between: <br />Leo Gehle and Arla Beth Gehle, husband and wife (hereinafter "the Gehles "), of 3758 S. 110 <br />Road, Wood River, Nebraska 68883, the owners of a tract of land located in the East Half of the <br />Northeast Quarter of the Southeast Quarter of Section33, Township l 1 North, Range 11 West of the <br />611 P.M., Hall County, Nebraska, which tract adjoins Lot 1, Gehle Subdivision on the West; and <br />Rick Rodocker and Brenda Rodocker, husband and wife (hereinafter "the Rodockers "), <br />whose address will be 3738 S. 110 Road, Wood River, Nebraska 68883, who are the purchasers of <br />l..ot 1, Gehle Subdivision, a subdivision located in t fie Ewir -Half of thc- Northmt Quarter of the <br />Southeast Quarter of Section33, 'Township 11 North, Range 11 West of the 611 RM., Ball County, <br />Nebraska. <br />Whereas, Lot 1 of Gehle Subdivision has a residence located upon it, but does not have a <br />water well to supply water to the residence located on said Lot 1; <br />Whereas, the domestic water well which supplies water to Lot 1, Gehle Subdivision is <br />located on the farmland which adjoins said. Lo, t,1, to the, West; and is pwned.by the Gehles; <br />Whereas the parties desire to enter into all agreement regarding the water supply to Lot 1, <br />(iehle Subdivision. <br />Now, therefore, the parties agree as follows: <br />This agreement is between the Gehles and the Rodockers and is personal to them and will <br />not be considered to run with the land. <br />2. In consideration of One Dollar and other good and valuable consideration, receipt of which <br />edged by the Gehles, the Gehles agree that the domestic water well located <br />on their property described above shall continue to provide the water to the Rodockers on Lot <br />1, Gehle Subdivision for all domestic purposes whatsoever. <br />3. The Rodockers shall have the right to maintain a pipeline from said water well across <br />Gehle's property to Lot 1, Gehle Subdivision. <br />4, The Rodockers shall be responsible for any expense related to maintaining the pipeline from <br />the water well to Lot 1, Gehle Subdivision. <br />5.
