Mayer, Jr. Trust does hereby grant the following described non-exclusive permissive use of the West Twelve Feet (12') of the real estate hereinafter referred to as the Twelve Feet (12') and described upon Exhibit A which is attached hereto and made a part hereof by this reference to Oakwood Condominium Unit Owners Association, Inc. (Permittee), which is the manager of Oakwood Condominiums in the City of Grand Island, Hall County, Nebraska. The non-exclusive permissive use is given to Permittee, its employees and agents and is limited to the privilege of entering upon the Twelve Feet (12') for the purpose of mowing and maintaining it as a lawn and using the lawn as an accompaniment to the adjacent Condominium Owners' lawn. However, the Permittee shall have no duty to either enter the Twelve Feet (12') or to plant or mow grass there. The Permittee, its employees and agents shall not plant anything upon the Twelve Feet (12') except lawn grass and shall not install, place or construct anything else or allow anything else to remain upon, over, along or underneath the surface of the Twelve Feet (12'). THE TRUSTEE OR ANY SUCCESSOR TRUSTEE OF THE HERBERT F. MAYER, JR. TRUST AND ANY GRANTEE THEREFROM MAY REVOKE THE ABOVE STATED PERMITTED USE AT ANY TIME WITHOUT NOTICE TO THE PERMITTEE. ACCEPTANCE The above named Permittee for itself and its successors and assigns and persons entering the Twelve Feet (12') with its permission or knowledge hereby accept the above grant of non- exclusive limited use and acknowledge that it has no right, title, claim or interest in the Twelve Feet (12') and that it will not acquire any right, title, claim or interest therein by its using the Twelve Feet (12').
