Mayer, Trustee of the Herbert F. Mayer, Jr. Trust does hereby grant the following described non-exclusive permissive use of the West Twelve Feet (12') of the real estate hereinafter referred to as the Twelve Feet (12') and described upon Exhibit A which is attached hereto and made a part hereof by this reference to William J. Thiemann, Trustee of the William J. Thiemann Living Revocable Trust and Cynthia A. Thiemann, Trustee of the Cynthia A. Thiemann Living Revocable Trust, who are the Condominium Owners of Unit 20 in Oakwood Condominiums in the City of Grand Island, Hall County, Nebraska. The non-exclusive permissive use is limited to the privilege of entering upon the Twelve Feet (12') for the purpose of mowing and maintaining it as a lawn and using the lawn as an accompaniment to the adjacent Condominium Owners' lawn. However, the Condominium Owners shall have no duty to either enter the Twelve Feet (12') or to plant or mow grass there. The Condominium Owners shall be solely responsible for any injury incurred by them on the Twelve Feet (12') or any person entering the Twelve Feet (12') with the Condominium Owners' permission or knowledge. The Condominium Owners shall not plant anything upon the Twelve Feet (12') except lawn grass and shall not install, place or construct anything else or allow anything else to remain upon, over, along or underneath the surface of the Twelve Feet (12' ) . THE TRUSTEE OR ANY SUCCESSOR TRUSTEE OF THE HERBERT F. MAYER, JR. TRUST AND ANY GRANTEE THEREFROM MAY REVOKE THE ABOVE STATED PERMITTED USE AT ANY TIME WITHOUT NOTICE TO THE CONDOMINIUM OWNERS. ACCEPTANCE The above named Condominium Owners for themselves and for their grantees, heirs, personal representatives, tenants and persons entering the Twelve Feet (12') with their permission or knowledge hereby accept the above grant of non-exclusive limited use and acknowledge that they have no right, title, claim or interest in the Twelve Feet (12') and that they will not acquire any right, title, claim or interest therein by their using the Twelve Feet (12'). This acceptance is binding upon the Condominium Owners and upon their grantees, heirs, personal representatives, tenants and all other persons entering upon the Twelve Feet (12') with their permission or knowledge as a 1
