Mayer, Trustee of the Herbert F. Mayer, Jr. <br />Trust does hereby grant the following described non-exclusive <br />permissive use of the West Twelve Feet (12') of the real estate <br />hereinafter referred to as the Twelve Feet (12') and described <br />upon Exhibit A which is attached hereto and made a part hereof <br />by this reference to William J. Thiemann, Trustee of the William <br />J. Thiemann Living Revocable Trust and Cynthia A. Thiemann, <br />Trustee of the Cynthia A. Thiemann Living Revocable Trust, who <br />are the Condominium Owners of Unit 20 in Oakwood Condominiums in <br />the City of Grand Island, Hall County, Nebraska. <br /> <br />The non-exclusive permissive use is limited to the <br />privilege of entering upon the Twelve Feet (12') for the purpose <br />of mowing and maintaining it as a lawn and using the lawn as an <br />accompaniment to the adjacent Condominium Owners' lawn. <br />However, the Condominium Owners shall have no duty to either <br />enter the Twelve Feet (12') or to plant or mow grass there. <br /> <br />The Condominium Owners shall be solely responsible for any <br />injury incurred by them on the Twelve Feet (12') or any person <br />entering the Twelve Feet (12') with the Condominium Owners' <br />permission or knowledge. <br /> <br />The Condominium Owners shall not plant anything upon the <br />Twelve Feet (12') except lawn grass and shall not install, place <br />or construct anything else or allow anything else to remain <br />upon, over, along or underneath the surface of the Twelve Feet <br />(12' ) . <br /> <br />THE TRUSTEE OR ANY SUCCESSOR TRUSTEE OF THE HERBERT F. <br />MAYER, JR. TRUST AND ANY GRANTEE THEREFROM MAY REVOKE THE ABOVE <br />STATED PERMITTED USE AT ANY TIME WITHOUT NOTICE TO THE <br />CONDOMINIUM OWNERS. <br /> <br />ACCEPTANCE <br /> <br />The above named Condominium Owners for themselves and for <br />their grantees, heirs, personal representatives, tenants and <br />persons entering the Twelve Feet (12') with their permission or <br />knowledge hereby accept the above grant of non-exclusive limited <br />use and acknowledge that they have no right, title, claim or <br />interest in the Twelve Feet (12') and that they will not acquire <br />any right, title, claim or interest therein by their using the <br />Twelve Feet (12'). This acceptance is binding upon the <br />Condominium Owners and upon their grantees, heirs, personal <br />representatives, tenants and all other persons entering upon the <br />Twelve Feet (12') with their permission or knowledge as a <br />1 <br />
