Mayer, Trustee of the Herbert F. Mayer, Jr. Trust does hereby grant the following described non-exclusive permissive use of the West Twelve Feet (12') of the real estate hereinafter referred to as the Twelve Feet (12') and described upon Exhibit A which is attached hereto and made a part hereof by this reference to Karen A. Frauen who is the Condominium Owner of Unit 15 in Oakwood Condominiums in the City of Grand Island, Hall County, Nebraska. The non-exclusive permissive use is limited to the privilege of entering upon the Twelve Feet (12') for the purpose of mowing and maintaining it as a lawn and using the lawn as an accompaniment to the adjacent Condominium Owner's lawn. However, the Condominium Owner shall have no duty to either enter the Twelve Feet (12') or to plant or mow grass there. The Condominium Owner shall be solely responsible for any injury incurred by them on the Twelve Feet (12') or any person entering the Twelve Feet (12') with the Condominium Owner's permission or knowledge. The Condominium Owner shall not plant anything upon the Twelve Feet (12') except lawn grass and shall not install, place or construct anything else or allow anything else to remain upon, over, along or underneath the surface of the Twelve Feet (12 I ) . THE TRUSTEE OR ANY SUCCESSOR TRUSTEE OF THE HERBERT F. MAYER, JR. TRUST AND ANY GRANTEE THEREFROM MAY REVOKE THE ABOVE STATED PERMITTED USE AT ANY TIME WITHOUT NOTICE TO THE CONDOMINIUM OWNER. ACCEPTANCE The above named Condominium Owner for herself and for her grantees, heirs, personal representatives, tenants and persons entering the Twelve Feet (12') with her permission or knowledge hereby accepts the above grant of non-exclusive limited use and acknowledge that she has no right, title, claim or interest in the Twelve Feet (12') and that she will not acquire any right, title, claim or interest therein by her using the Twelve Feet (12').
