Y! <br />-1 <br />For Official Use Out <br />DEED OF TRUST <br />THIS DEED OF TRUST is made on December 31, 2002. <br />The Trustor is VICTOR M. HENRIQUEZ and GNA A. HENRIQUEZ, a married couple, a/k/a Borrower. <br />The Trustee is DALE M. SHOT KOSKI, Assistant City Anomey. <br />The Beneficiary is THE CITY OF GRAND ISLAND, NEBRASKA, a municipal city corporation, a/Ida Lender. <br />Borrower irrevocably conveys to Trustee, in trust, with power of sale, the following: <br />Lot Nine (9), Lhtcoht View Estates Subdivision in the City of Grand Island, Hall County, Nebraska. <br />Together with all the rents and profits therefrom and subject to easements and restrictions of record, if any <br />Borrower owes Lender Nine Thousand (59,000), evidenced by Borrower's note of even date, payable according to <br />the terms thereof. <br />This Security instrument secures to Lender the Debt evidenced by said note, the payment of all other sums, with <br />interest, advanced under the provisions hereafter to protect the security and the performance of Borrower's <br />covenants and agreements. <br />Borrower covenants that Borrower is lawfully seised of such real estate and has the legal power and lawful authority <br />to convey the same and warrants and will defend title to the real estate against the lawful claims of all persons. <br />This Deed of Trust shall be deemed subordinate to the Deed of Trust between the Borrower and Cherry Creek <br />Mortgage Company of Grand Island executed on December 31, 2002, which secures the balance of the debt for the <br />purchase of the above described real estate and the Deed of Trust between the Borrower and the City of Grand <br />Island, Nebraska, a municipal corporation executed on December 31, 2002, which secures the debt in the amount of <br />$12,500.00 from the City's Down Payment Assistance Program. <br />BORROWER AND LENDER AGREE AS FOLLOWS: <br />Borrower shall pay when due, the principal and interest as provided in said note. <br />2. Borrower shall pay all general real estate taxes and special assessments against the property before the same <br />become delinquent <br />3.
