<br />DEED OF TRUST MODIFICATION AGREEMENT
<br />'HIS DEED OF TRUST MODIFICATION AGREEMENT made and executed
<br />this_ day of -,)e m...lo.r, 2002, by and between SKAG -WAY DISCOUNT DEPT.
<br />STORES, INC., a Nebraska corporation, hereinafter referred to as "Trustor ", and
<br />HERITAGE BANK, hereinafter referred to as "Beneficiary".
<br />WITNESSETIL
<br />WIIEREAS, Trustor did on March 2, 2001, execute a certain Real Estate Deed of j
<br />Trust that originally secured a Heritage Bank Note 2310408, dated March 2, 2001, in the -
<br />original amount of Iwo Million Four Hundred Thousand and No/ 100 Dollars S
<br />($2,400,000.00) and is collateral security for Heritage Bank Note 2101550, dated March
<br />2, 2001, in the original amount of Two Million One IIundred Thousand ($2,100,000.00);
<br />WIIEREAS, such Real Estate Decd of Trust further secures all renewals,
<br />modifications, substitutions, and future advances to the extent of total indebtedness not
<br />exceeding Four Million Five Hundred Thousand and No /100 Dollars ($4,500,000.00);
<br />WHEREAS, the Real Estate Deed of Trust described above was filed of record in
<br />the Office of the Hall County Register of Deeds on March 8, 2001, as Instrument No.
<br />200101839, in respect to that real estate described as:
<br />A tract of land comprising all of Lots Fifteen (15) and Sixteen (16); the
<br />easterly Eighty-Right (88) feet of Lot Seventeen (17); the Southerly Filly -
<br />Two and Sixty-Seven Hundredths (52.67) feet of the Northerly One
<br />Hundred Twenty -Six and Thirty-Three Hundredths (126.33) feet of the
<br />Westerly One Hundred Thirty-Two (132.0) feet of Lot Seventeen (17);
<br />and the Westerly Thirty -Two (32.0) feet of the Easterly One IIundred
<br />Twenty (120.0) feet of the Southerly One Hundred Fifty -Eight (158.0) feet
<br />of Lot Seventeen (17), all in IIome Subdivision in the City of Grand
<br />Island, Halt County, Nebraska; AND
<br />A tract of land comprising all of Lot Six (6), IIome Subdivision in the City
<br />of Grand Island, Hall County, Nebraska, EXCEPTING THEREFROM the
<br />Westerly Two IIundred Fifty (25(10) feet of the Northerly One Hundred
<br />'Thirty -Five (135.0) feet thereof AND the Westerly Two IIundred Sixty
<br />(260.0) feet of the Southerly One Hundred Fifty (150.0) feet thereof; AND
<br />A tract of land comprising a part of Lot Five (5), Home Subdivision, in the
<br />City of Grand Island, Hall County, Nebraska, more particularly described
<br />as follows: Beginning at a point on the South line of said Lot Five (5),
<br />said point being Two Hundred Sixty (260.0) feet East of the Southwest
<br />Corner of said Lot Five (5); thence Easterly along the South line of said
<br />Lot Five (5), a distance of One Hundred 'Twenty-Nine and Sixty -Pour
<br />Hundredths (129.64) feet to the Southwest comer of Holiday Garden
<br />Second Subdivision; thence Northerly along the West line of said IIoliday
