Lienholder is the holder of the beneficial interest in a note secured by a deed of trust (the `Second Deed of Trust ") on the <br />mortgaged property, dated April 4, 2000, executed by Brian K Rapp and Shelly L Rapp, Husband and Wife, and recorded on <br />April 7, 2000, as Instrument No. 20110271 R in the office of the Register of Deeds of Hall County, Nebraska, and further described <br />as follows (the "Mortgaged Property"): <br />The Southerly 'fhirteen and Four Tenths Feet (S13.4') of Lot Nine (9) and the Northerly Fifty -Two and Eight Tenths Feet <br />(N52.8') of Lot Ten (10), in Block Eleven (11), in West Park Addition to the City of Grand Island, hall County, Nebraska. <br />B. The Second Deed of Trust held by Lienholder is junior and subordinate to a deed of trust (the "First Deed of Trust ") held by <br />Major Mortgage, it's successors and /or assigns, on the Mortgaged Property. Brian K Rapp and Shelly L Rapp, Husband and <br />Wife, the owners ( "Owner") of the Mortgaged Property desire to refinance the First Deed of Trust loan on the Mortgaged <br />Property. <br />For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, Lienholder agrees as follows: <br />1. The Second Deed of Trust held by Lienholder shall be subject and subordinate to a new deed of trust ( "New Deed of Trust") <br />securing a loan originated by Major Mortgage, it's Successors and /or assigns, pertaining to the Mortgaged Property and securing <br />a note dated oo or around November 22, 2002, in an ofig.nal principal amount no: to exceed Soventy Six Thousand Six Ilardred <br />fifty Dollars ($76,650.00), bearing interest at a rate not to exceed Five and one -half percent (5.50%) per annum, and made <br />primarily for the purpose of refinancing the First Deed of Trust loan.
