JANOVEC, Husband and Wife, ( Trustor), whose mailing address is <br />/1 /95 QP C p Ln l& run A Fsland, NE, TIM HINKLE, a member of the Nebraska State Bar <br />Association, (Trustee), whose mailing address is 5801 S. 58t' St., Suite B, Lincoln, NE 68516 and <br />NICHOLAS VUKO and DONNA VUKO, husband and Wife (Beneficiaries), whose mailing address is c' <br />1501 S. 98" Street, Lincoln, NE 68520. <br />FOR VALUABLE CONSIDERATION, Trustor irrevocably transfers, conveys and assigns to <br />Trustee, IN TRUST, WITH POWER OF SALE, for the benefit and security of Beneficiary, under and <br />subject to the terms and conditions of this Deed of Trust, the real property, located in the County of <br />Lancaster, State of Nebraska, and described as follows (the `Property"): <br />A tract of land comprising the north forty -eight (48) feet of Lot six (6), and part of the <br />north forty -eight (48) feet of Lots Seven (7) and Eight (8), all in Block Eight (8) of Wiebe's <br />Addition to the City of Grand Island, Hall County, Nebraska, more particularly described as <br />follows: <br />Beginning at the northwesterly comer of said Lot 6; thence running southeasterly <br />along the southwesterly line of said Lot 6 a distance of forty -eight (48) feet; thence running <br />northeasterly parallel to the northwesterly line of said Lots 6, 7, and 8 a distance of one <br />hundred twenty -seven and sixty- seventh hundredths (127.67) feet to a point that is ten (10) <br />feet westerly (measured perpendicularly) from the back of curb of paving on Locust Street; <br />thence running northerly parallel to said curb a distance of fifty -five and fifty -five hundredths <br />(55.55) feet to a point on the northwesterly line of said Lot 8; thence running southwesterly <br />along the northwesterly line of said Lots 8, 7 and 6 a distance of one hundred fifty -three and <br />eighty -four hundredths (153.84) feet to the point of beginning. <br />and <br />The northerly Fifty -Four (54) Feet of Lot Five (5), in Block Eight (8) of Wiebe's <br />Addition to the City of Grand Island, Hall County, Nebraska; <br />and <br />The Southerly seventy-eight feet (S 78') of Lots Five (5), Six (6), Seven (7) and Eight <br />(8), in Block Eight (8) of Wiebe's Addition to the City of Grand Island, Hall County, <br />Nebraska. <br />TOGETHER WITH, all rents, easements, appurtenances, hereditaments, interest in adjoining roads, <br />streets and alleys, improvements and buildings of any kind situated thereon and all personal property that <br />may be or hereafter become an integral part of such buildings and improvements, all crops raised thereon, <br />and all water rights. <br />The Property and the entire estate and interest conveyed to the Trustee are referred to collectively <br />as the "Trust Estate." <br />FOR PURPOSE OF SECURING: <br />a. Payment of indebtedness in the total principal amount of One Hundred Sixty -Five Thousand <br />Dollars (5165,000.00), with interest thereon, as evidenced by that certain promissory note of even date (the <br />"Note ") due January 1, 2008 executed by Trustor, which has been delivered and is payable to the order of <br />Beneficiary, and which by this reference is hereby made a part hereof, including any and all modifications, <br />extensions and renewals thereof; and <br />b.
