Said <br />Deed of Trust was recorded in the Office of the Register of Deeds of Hall County, Nebraska, and filed <br />on December 20, 1996, as Document No. 96- 109928 of the Mortgage Records of Hall County, Nebraska. <br />Wells Fargo Bank Nebraska, National Association, was appointed as Trustee, replacing Arend R <br />Baack, by virtue of a Substitution of Trustee dated April 8, 2002, and filed for record on April 12, <br />2002, as Document No. 0200203982 of the Miscellaneous Records of Hall County, Nebraska. <br />WELLS FARGO BANK NEBRASKA, NATIONAL ASSOCIATION, Grantor, in consideration <br />of the sum of Fifty -three thousand seven hundred twenty -seven and 45/100 Dollars ($53,727.45) and <br />other good and valuable consideration received from WELLS FARGO BANK NEBRASKA, <br />NATIONAL ASSOCIATION, does hereby grant, bargain, sell, convey and confirm unto WELLS <br />FARGO BANK NEBRASKA, NATIONAL ASSOCIATION (hereinafter "Grantee" where <br />appropriate), the following- described real property in Hall County, Nebraska, to wit: <br />Lot 6, Block 3, LAMBERTS ADDITION, City of Grand Island, <br />Hall County, Nebraska. <br />to have and to hold the above - described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br />1. That Mark Keith, as Truster. failed to pav to Beneficiary payments which were contractually <br />due, and the Grantor, at the request of the Beneficiary, elected to declare the entire unpaid <br />principal balance, together with interest thereon at once immediately due and payable. <br />2. That a Notice of Default as required by § 76 -1006 was filed by Grantor on April 22, 2002 as <br />Instrument No. 0200204360 of the Miscellaneous Records in the office of the Register of <br />Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed to <br />all parties entitled to notice, pursuant to said Deed of Trust and in compliance with § 76- <br />1008, R.R.S. Nebraska. <br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br />4. That Wells Fargo Bank Nebraska, National Association obtained anOrderfor Relief in Mark <br />Keith's Chapter 13 Bankruptcy on September 19, 2002. A copy of said Order is attached <br />hereto and marked as Exhibit "A ". <br />5. That a Notice of Trustee's Sale was filed by Grantor on October 1, 2002 as Instrument No. <br />0200210440 of the Miscellaneous Records in the office of the Register of Deeds of Hall <br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter <br />mailed to all parties entitled to notice pursuant to said Deed ofTrust and in compliance with <br />§ 76- 1608, R.R.S. Nebraska. <br />6.
