WHEREAS, NAFCO NE Federal Credit Union (hereinafter referred to as
<br />'NAFCO-), is the Beneficiary and holder a Deed of Trust executed by Edwin R. Sisson and Marian
<br />G. Sisson, husband and wife, dated August 31, 1990, and recorded September 6, 1990, as Instrument
<br />No. 90- 105162; a Deed of'1'rust executed by Edwin R. Sisson and Marian G. Sisson, husband and
<br />wife, dated May 16, 1995, and recorded May 18, 1995, as Instrument No. 95- 103223; and a Deed of
<br />Trust executed by Edwin R. Sisson and Marian G. Sisson, husband and wife, dated February 2, 200 t,
<br />and recorded February 14, 2001, as Instrument No. 2001-01086, all in the records of Hall County,
<br />Nebraska, covering the following described real estate, to -wit:
<br />Lots 14 and t5 Eaglewood Acres Subdivision, Hall County, Nebraska (the "Subject
<br />Real Estate ");
<br />WHEREAS, Edwin R. Sisson and Marian G. Sisson, ( "Borrowers)" desire to obtain a
<br />loan in the amount of $100,000 from'l'ier One (hereinafter referred to as "I coder "); and
<br />WHEREAS, Leader's Deed of Trust should be paramount and superior to each and
<br />all of the liens of "NAFCO ".
<br />NOW, THEREFORE, in consideration of One Dollar ($1.00) and other valuable
<br />consideration to NAFCO, the receipt whereof is hereby acknowledged, NAFCO does hereby waive
<br />the priority of each and all of its Deeds of Trust as described above and any other security it may
<br />have in the subject real estate and agrees that said Lender's Deed of Trust shall be superior to said
<br />NAFCO's Deeds of Trost and NAFCO agrees that each and all of their Deeds of frost executed and
<br />recorded prior in time to said Lenders' Deeds of Trust shall be subject, junior, and subordinate to the
<br />Deeds of Trust of Lender.
<br />Provided, however, that nothing herein contained shall operate in any way to release
<br />or affect the validity of NAFCO's security instruments as liens upon the Subject Real Estate or to
<br />otherwise affect the priority of said NAFCO's lien except as herein provided.
<br />This Agreement shall be binding upon the undersigned and its successors and assigns.
