<br />EASEMENT AGRCSMMU
<br />This Agreement is made and entered into this Pj ii day of
<br />July, 1986, by and between the Prudential Insurance Company of
<br />America, a Corporation, hereinafter referred to as "Prudential,"
<br />and Glenwood H. Hargens and Jane H. Hargens, husband and wife, as
<br />joint tenants with rights of survivorship, hereinafter referred
<br />to as "Hargens," whether one or more.
<br />W I T N E S S E T H
<br />WHEREAS, Hargens is the owner of the following described farm
<br />- i+. -0. s11!tsateri in Hall Countv. Nebraska, to -wit:
<br />The Northwest Quarter (NW 1/4), Section Twenty - Three (23),
<br />Township Eleven (11) North, Range 'Teri (10), West of the
<br />6th P.M., Hall County, Nebraska;
<br />and,
<br />WHEREAS, Prudential is the owner of the following described
<br />real estate, situated in Hall County, Nebraska, to -wit:
<br />The West Half of The Northeast Quarter (W 112 NE 1/4),
<br />Section Twenty -Three (23), Township Eleven (11) North,
<br />Range Ten (10), West of the 6th P.M., Hall County,
<br />Nebraska;
<br />and,
<br />WHEREAS, the two tracts of land herein described adjoin each
<br />other; and,
<br />WHEREAS, Hargens has maintained an existing drain over property
<br />of Prudential as herein described, and Hargens desires to deepen,
<br />widen and continue to maintain said existing drainage ditch.
<br />NOW, THEREFORE, in consideration of One Dollar (.$1.00) and
<br />other good and valuable consideration, the receipt and adequacy of
<br />which is hereby acknowledged by Prudential, Prudential does
<br />hereby grant an easement to Hargens, their heirs, successors and
<br />assigns to construct, maintain, deepen and keep in repair an open
<br />ditch or drain over the following described property owned by
<br />Prudential, to -wit:
<br />A parcel of land located in the West Half of the Northeast
<br />Quarter (W 1/2 NE 1/4) of Section 'Twenty -Three (23),
<br />Township Eleven (11) North, Range Ten (10), West of the
<br />6th P.M., Hall County, Nebraska, more particularly
<br />described as follows:
