Issuance to Lender of a ALTA Form 110.5 endorsement to its ALTA Lender's Title <br />Policy, in form satisfactory to Lender, insuring the continued first lien priority of the Deed of Trust as <br />presently insured in said policy, except for non - delinquent taxes and such exceptions as may be <br />approved by Lender in its sole discretion. <br />3.3. Payment of all title company charges in connection with issuance of the aforesaid <br />title policy endorsements, including recording charges, plus the cost of Lender's documentation and legal <br />counset in connection with this transaction. <br />3.4. Satisfaction of all other terms set forth in the Modification Agreement and otherwise <br />specified by Lender. <br />4.
