<br />This Agreement made thisj;& day of Octoher. 2002. between TeamBank, NA., and its
<br />successors and/or assigns, ("Lendee) with offices at 1902 Harlan Drive, Bellevue, Nebraska
<br />68005, and Home Federal Savings and Loan Assn., its successors and/or assigns, ( "Bank's with
<br />offices at 221 South Locust, Grand Island, Nebraska, 68802.
<br />WHEREAS, Bank is the beneficiary under a Tmst Deed dated November S. 2001 , and
<br />filed November 19, 2001, in the Register of Deeds Office as Document No. 2001 1 1796. Hall
<br />County, Nebraska, to secure a loan in the original principal amount of $10,073.00, tom
<br />DiMartino and Marilyn M. Martino, Husband and Wife , ("Borrower (sy) and covering the
<br />following described real estate
<br />Lot 38, Ravenwood Subdivision, Hall County, an Addition to the City of Grand Island, as
<br />surveyed, platted, and recorded in Hall County, Nebraska.
<br />Also commonly known as: 4603 Tara Place, Grand island, Nebraska 68802
<br />WHEREAS, Lender has requested Bank and Bank has agreed to subordinate the lien of
<br />its Trust Deed to the mortgage or trust deed to be taken by Lender.
<br />NOW, THEREFORE, in consideration of the premises the parties agree as follows:
<br />Bank hereby expressly subordinates the Hen of the above described Trust Deed to the lica
<br />of any mortgage or trust deed taken by Lander from Borrowers and declares the lien of the Trust
<br />Deed to be junior and inferior to the lien of Lender upon the lands described therein; provided,
<br />however, that the subordination of the Trust Dad of Bank shall not apply or be cffcctive as to
<br />any amounts, exclusive of interest, in excess of $160,513.00 secured by the mortgage or Trust
<br />Deed of Lender, dated in October, 2002., filed 11"7-Oa as Doc. No.
