<br />This instrument, made this Y day of October, 2002, between Eric H. Lindquist, a member
<br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "(irantor', pursuant to
<br />a power of sale contained in that certain Deed of Trust recorded on September 30, 1994 as
<br />Instrument No. 94- 108139 of the Mortgage Records in the office of the Register of Deeds of Hall
<br />County, Nebraska, and Federal National Mortgage Association, hereinafter called "Grantee ":
<br />WHEREAS, on July 2, 2002, Eric H. Lindquist, as Successor Trustee, executed a Notice of
<br />Default pursuant to which notice was given to Richard A. Gardner, a single person, Trustor, under
<br />that certain Deed of Trust recorded on September 30, 1994 as Instrument No. 94- 108139 of the
<br />Mortgage Records in the office of the Register of Deeds of Hall County, Nebraska, covering that
<br />certain premises described as:
<br />LOT 9, BLOCK 5, DALE ROUSH SECOND SUBDIVISION, CITY OF GRAND
<br />ISLAND, HALL COUNTY, NEBRASKA,
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on July 5, 2002 as Instrument No. 2002 -07086 of the Miscellaneous
<br />Records of said County.
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76 -1008 R.R.S. Nebraska.
<br />Subsequent thereto, beginning on August 6, 2002, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 at & Locust Street, Grand
<br />Island, Nebraska, at 10:00 a.m. on September 17, 2002. Publication of such notice was made for
<br />five consecutive weeks on August 6, 2002, August 13, 2002, August 20 2002, August 27, 2002 and
<br />September 3, 2002, the last publication being at least ten (10) days but not more than thirty (30)
<br />days prior to the date of sale.
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76 -1008
<br />R.R.S. Nebraska.
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Eric H.
<br />Lindquist, Successor Trustee, did at the time and place mentioned in said Notice of Trustee's Sale,
<br />offer said properly for sale at public auction, and did sell the same to Chevy Chase Bank, FSB for
<br />the sum of $56,529.25, it being the highest bidder therefor. Chevy Chase Bank, FSB has assigned
<br />all of its right, title, and interest in and to such bid to Grantee.
<br />NOW, THEREFORE, in consideration of the premises and of the sum of $56,529.25 so bid
<br />and paid as aforesaid, 1, Eric H. Lindquist, Successor Trustee, do hereby grant and convey unto said
