200211296 <br />(1) To take any necessary action to secure benefits and participation in programs offered by any federal, state, local, or foreign <br />governmental body, administrative agency, person or entity, including Social Security, Medicare, Medicaid and all other such benefits <br />to which I tray be entitled. <br />(m) To add assets deemed appropriate by my Agent to any trust created by me, if such trust is in existence at the trine, by <br />assigning, transfering and delivering any real or personal property to such trust, its trustee or trustees, notwithstanding the fact that <br />my Agent, or his or her spouse, descendants, heirs or assigns, may be a trustee, beneficiary, or holder of any special or general power <br />of appointment under such trust; to amend and revoke consistent with the terms of such trust if such trust is revocable by me and the <br />mist instrument specifically grants such power of amendment or revocation to my legally appointed Attorney -in -Fact; and to exercise <br />appointment and removal powers under any trusts which I have established. <br />(n) To renounce or disclaim any property or interest in property orpowers to which l may become entitled, whether by gift, testate <br />or intestate succession. <br />o) To snake unlimited gifts to my spouse even if my spouse is my attomey -m- fact. To make gifts, outtight or in trust, in any year <br />in an amount not greater than the amount as may then qualify for the federal gift tax annual exclusion to any of my descendants <br />(including my Agent, if my Agent is also my descendant) and to the spouse of any of my descendants, provided, however, that any <br />child of mine acting as my Agent may make such gifts to himself or herself only if an identical gift is also made at such time to each <br />of my other then living children. <br />(p) To make gifts, grants or other transfers without consideration either outright or in trust, to such charitable organizations , as <br />my Agent shall select, provided however, that gifts made by my Agent to a charitable, religious, scientific, or educational institution <br />or organization must qualify for a charitable deduction under the income and gift tax provisions of the Internal Revenue Code of 1986, <br />as amended. <br />(q) To sue or take other appropriate legal action, including injunctive relief, against any person, entity, corporation or other third <br />party for their TO to honor this Power of Attorney and/or comply with the directions of my Agent acting hereunder. <br />(r) To serve as my conservator if it is necessary at any time for a court to appoint a conservator for my estate <br />2. This Power of Attorney is to be construed and interpreted as a durable power of attorney in accordance with the Nebraska <br />Uniform Durable Power of Attorney Act. This power of attorney shall not be affected by the subsequent disability or incapacity of the <br />principal. The enumeration of specific items, rights, acts, or powers herein is not intended to, nor does it limit or restrict, and it is not to <br />be eoostmed or interpreted as limiting or restricting, the general powers herein granted to my Agent <br />Any authority granted to my Agent, however, shall be limited so as to prevent this Power of Attorney (a) from causing my <br />Attorney to be taxed on my income; (b) from causing my estate to be subject to a general power of appointment (as that term is defined <br />by Section 2041 of the Internal Revenue Code of 1986, as amended) by my Agent, and (c) from causing my Agent to have any incidents <br />of ownership (within the meaning of Section 2042 of the Internal Revenue Code of 1986, as amended) with regard to any life insurance <br />policies on the life of my Agent. <br />3, My Agent shall notbe liable for any loss sustained through an met injudgmentmade in good fault, but shall be liable for willful <br />n. My Agent understands that this Power of Attorney is given without any express or implied <br />promise of compensation to my Agent. Any services performed as my Agent will be done without compensation, either during my lifetime <br />or upon my death, but my Agent shall be entitled to reimbursement for all reasonable expenses incurred as a result of carrying out any <br />provisions of this Power of Attorney. <br />4.
