200211158 <br />PARTY DRIVEWAY AND GARAGE AGREEMENT <br />THIS AGREEMENT is made and entered into this / &l — day of <br />July, 2001, by and between GRACE V. GREENFIELD, a single person, <br />residing at 1121 West 12th Street, Grand Island, Nebraska 68801 <br />(herein called the "First Party ") and COAD J. MILLER and MARTINA P. <br />DOETSCH, husband and wife, owners of the property located at 1117 <br />North Washington, Grand Island, Nebraska 68801 (herein called the <br />"Second Parties "). <br />Recitals <br />A. First Party is the owner of certain real property <br />commonly known as 1121 West 12th Street, Grand Island, Nebraska <br />68801, said premises being legally described as follows: <br />The North 64.8 feet of Lot Five (5), Block Four (4), <br />Gilbert's Addition to the City of Grand Island, Hall <br />County, Nebraska. <br />B. Second Parties are the owners of certain real property <br />commonly known as 1117 North Washington, Grand Island, Nebraska <br />68801, said premises being legally described as follows: <br />The Southerly 67.2 feet of Lot Five (5), Block Four (4), <br />Gilbert's Addition to the City of Grand Island, Hall <br />County, Nebraska. <br />C. The driveway improvements and garage on the respective <br />properties adjoin and abut each other, along a common property line <br />between the two properties, and neither driveway improvement alone <br />�S sufficient to accommodate the vehicular traffic relating to the <br />use of the respective properties; but both driveway improvements, <br />together, are sufficient and adequate for the vehicular traffic of <br />both properties. <br />D. By this Agreement, the parties wish to make provisions <br />for the unobstructed use of said respective driveway improvements <br />for ingress and egress and for the maintenance of said improvements <br />for their mutual benefit. <br />E. The parties' garages are attached to each other as a <br />common building and they want to make provision for upkeep and <br />maintenance thereof. <br />
