200210514 <br />Commencing at the northeast corner of Lot 1 of said Subdivision, said point also being the <br />point of beginning; thence N90 000'00 "W along and upon the north line of said Lot 1 a <br />distance of 7.98 feet to the point of intersection of said north line and the east line of an <br />existing Utility Easement; thence N00 °26'41 "W along and upon said easement linewhich is <br />10 feet east of and parallel to the westproperty line of Lot 3 of said Subdivision a distance of <br />149.65 feet; thence N89 °33'09 "E along and upon an existing easement line which is 10 feet <br />south of and parallel to the north line of said Lot 3 a distance of 13.35 feet; thence departing <br />said easement line S00 °26'41 "E a distance of 165.10 feet to a point on the east line of Lot 1 <br />of said subdivsion; thence N19 °41'09 "W along and upon said east line a distance of 16.29 <br />feet to the point of beginning, said Utility Easement contains 2039.72 square feet more or <br />less; <br />together with the following rights, namely, unrestricted ingress and egress under, over, and <br />across such land for the purpose of exercising the rights herein granted, to excavate and refill ditches <br />and trenches, and the right to clear and keep clear of trees, roots, brush, hedges, undergrowth, and <br />other obstructions from the surface of such tracts interfering with the location, construction, <br />inspection, repair, replacement, removal, and maintenance of such utilities. Any such utilities and <br />appurtenances placed upon, over, and under such tracts of land shall remain the property of the <br />Grantee and may be removed or replaced at any time. <br />The Grantors, for themselves, their heirs, executors, administrators, successors, and assigns, <br />hereby covenant that no buildings, fences, or structures shall be erected or permitted on said tract and <br />that the easement herein granted shall run with the title to such tract of land and be binding upon the <br />Grantors, their successors and assigns. <br />-2- <br />
