<br />NOTICE IS HEREBY GIVEN that on the day of September, 2002, Manufacturers & Traders
<br />Trust Company, One M & T Plaza, Buffalo, New York, 14203 -2399, Trustee for Securitiaation Series 1998 -1,
<br />Agreement dated 3- 01 -98, by and through its loan servicing agent, Fairbanks Capital Corp., as plaintiff, filed
<br />O
<br />its Petition in the District Court of Hall County, Nebraska, against Louise J. Burns, Joe K. Bums, Sr., and
<br />Sanitary Plumbing, Inc., as defendants, the object and prayer of such Petition being to obtain an accounting, to
<br />foreclose a deed of trust given by said Louise J. Bums and Joe K. Bruns, Sr., wife and husband, to Sandm M.
<br />Koenig, as Trustee for the benefit of North American Mortgage Company, Beneficiary, to foreclose any
<br />interest in or lien upon the real estate hereinafter described of the above -named defendants, to obtain an order
<br />for the sale of the real estate hereinafter described for the satisfaction of the indebtedness secured by such deed
<br />of trust and to obtain other equitable relief; that such deed of trust is dated February 3, 1998 and was recorded
<br />February 4, 1998, as Instrument No. 98- 100914 of the Mortgage Records of Hall County, Nebraska, and
<br />conveyed to such beneficiary the following described real estate situated in Hall County, Nebraska, to -wit:
<br />LOT ONE (1), BLOCK TWENTY -TWO (22), COLLEGE ADDITION TO WEST LAWN, AN
<br />ADDITION TO THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA;
<br />that such deed of trust was sold, transferred, and assigned to ContiMortgage Corporation by written
<br />assignment recorded on May 11, 1998, as Instrument No. 98- 104392 of the Mortgage Records of Hall County,
<br />Nebraska; and that such deed of trust was sold, transferred, and assured to the plaintiff by written assignment
<br />recorded on November 29, 2001, as Instrument No. 2001 -2203 of the Mortgage Records of Hall County,
<br />Nebraska.
