The undersigned, pursuant to Nebraska Revised Statutes, Section 76 -1006, files this
<br />Notice of Default. On the January 14, 1998, a Deed of Trust was executed and delivered by
<br />Cindy J. Martin, a single person, Trustor, with James B. Respeliers as Trustee, and Stanley G. a
<br />Birge and Paula A. Birge, husband and wife as Beneficiary, on the following- described property:
<br />Lots five (5) and six (6), in Block one (1), Burger's Addition to the Village
<br />of Domphan, Hall County, Nebraska Excepting a certain tract more
<br />particularly described in Warranty Deed recorded as Document No. 84-
<br />004803
<br />and that said Deed of Trust was duly filed for record in the office of the Register of Deeds of
<br />Douglas County, Nebraska, on January 20, 1998, in Book 98, Page 100469.
<br />That a breach of the obligation for which the Trust property was conveyed as security has
<br />occurred in that Truster has failed and refused to make payment as required pursuant to said Note
<br />and Deed of Trust and that there is now due and owing, as of the 18th day of September, 2002,
<br />the principal sum of $31,564.74, plus unpaid interest of $1,149.49 as of September 18, 2002,
<br />plus unpaid real estate taxes of $1,995.15, plus accruing interest thereon and the holder of this
<br />Note elects to and does hereby declare the entire unpaid principal balance due and payable
<br />together with interest as set forth in said Note at sixteen percent (16 %) per annum from
<br />September 18th, until date of payment.
<br />Trustee has elected to sell or cause to be sold such property pursuant to the laws of the
<br />State of Nebraska, and shall file the Notice of Sale pursuant to Nebraska Revised Statutes,
<br />Section 76 -1007, at the expiration of thirty (30) days from the date of this Notice.
