NE 68802 FOR ER CORQER'S USE ONLY <br />MODIFICATION OF DEED OF TRUST <br />THIS MODIFICATION OF DEED OF TRUST dated September 15, 2002, is made and executed between <br />WILLIAM L MCLELLAN AND JANNAN E MCLELLAN, HUSBAND AND WIFE, whose address is 1606 ALLEN, <br />GRAND ISLAND, NE 68803; ( "Trustor ") and United Nebraska Bank, Grand Island Office, PO Box 5018, <br />Grand Island, NE 68802 ( "Lender "). <br />DEED OF TRUST. Lender and Truster have entered into a Deed of Trust dated September 16, 1998 (the 'Deed of Trust ") which has been <br />recorded in HALL County, Slate of Nebraska. as follows: <br />RECORDED AS INSTRUMENT NO. 99-109196 IN THE HALL COUNTY REGISTER OF DEEDS OFFICE ON SEPTEMBER 21, 199e AND <br />MODIFICATIONS OF DEED OF TRUST RECORDED AS INSTRUMENT NO. 020090`7)93 RECORDED ON SEPTEMBER 22, 200D AND <br />INSTRUMENT NO. 0200109591 DATED SEPTEMBER 21, 2001. <br />REAL PROPERTY DESCRIPTION. The Dead of Trust covers the following described real property located in HALL County, State of Nebraska: <br />LOT ONE (1), MCLELLAN SUBDIVISION, HALL COUNT', GRAND ISLAND, NEBRASKA <br />The Real Property or Its address is commonly known as 5180 W CAPITAL AV, GRAND ISLAND, NE 66803 <br />MODIFICATION. Lender and Trustor hereby modify the Dead of Trust as follows: <br />MATURITY DATE ON DEED OF TRUST IS EXTENDED TO SEPTEMBER 15, 2012. THE PRINCIPAL AMOUNT OF THIS DEED OF <br />TRUST IS INCREASED TO 516,000. <br />CONTINUING VALIDITY. Except as expressly modified above, the terms of the original Deed of Trust shalt remain unchanged and in full force <br />and effect. Consent by Lender to this Modification does not waive Lender's right to require strict performance of the Deed of Trust as changed <br />above nor obligate Lender to make any future modifications. Nothing in this Modification shall constitute a satisfaction of the promissory note or <br />other credit agreement secured by the Dead of Trust (the "Note"). It is the intention of Lender to retain as liable all parties to the Deed of Trust and <br />all parties, makers and endorsers to the Note, including accommodation parties, unless a party is expressly released by Lender in writing. Any <br />maker or endorser, Including accommodation makers, shall not be released by vidue of this Modification. If any person who signed the original <br />Dead of Trust does not sign this Modification, then all persons signing below acknowledge that this Modification is given conditionally, based on <br />the representation to Lender that the non- signing person consents to the changes and provisions of this Modification or otherwise will not be <br />released by it. This waiver applies not only to any initial extension or modification, but also to all such subsequent actions. <br />TRUSTOR ACKNOWLEDGES HAVING READ ALL THE PROVISIONS OF THIS MODIFICATION OF DEED OF TRUST AND TRUSTOR <br />AGREES TO ITS TERMS.
