The parties recite and declare that:
<br />a. Richard L. I Iarbaugh and Mary C. Harbaugh executed a Deed of Trust on July 24,
<br />1995 in favor of Beneficiary, which was recorded on May 13, 1996, in the office of the Register
<br />of Deeds of Hall County, State of Nebraska, as Document No. 96- 103672, covering the
<br />following described property:
<br />LOTTWENTY- SEVEN(27), MORNINGSIDEACRES 7717RD5U5IDIVISI0N IN TNECITYOF
<br />GRAND ISLAND, HALL COUNTY, NEBRASKA
<br />b. The above mentioned Deed of Trust was given as security for a Loan, described in
<br />such Deed of Trust, in the amount of One Hundred Fifteen Thousand and No /100 - --
<br />($115,000.00) Dollars, executed on July 24, 1995, by Trustor in favor of Beneficiary.
<br />c. Truster desires to obtain a loan in the amount of One Hundred Fifty -Three Thousand
<br />and No /100 - ($1 53,000.00)- - from Equitable Federal Savings Bank of Grand Island, P.O. Box
<br />160, City of Grand Island, County of Hall, State of Nebraska, herein referred to as lender, but
<br />lender requires that such loan be secured by a trust decd that will be prior to the Deed of Trust in
<br />favor of Beneficiary.
<br />d. Beneficiary is willing to subordinate the lien of the Deed of Trust in their favor
<br />insofar as it encumbers the above - described premises, to the trust deed made in favor
<br />of lender in order that Trustor may have a proper priority of such loan from lender.
<br />Said Deed of Trust securing lender's lien was recorded as Document No.
<br />- (�95�� in the Office of the Hall County Register of Deeds.
<br />For the reasons set forth above, and in consideration of the mumal covenants and
<br />promises of the parties hereto, Trustor and beneficiary covenant and agree as follows:
