2. On May 26, 1996, Darlene J. Malfetti, as Personal
<br />Representative of the Estate of Johanna Opp, conveyed the above -
<br />described real estate by a Deed of Distribution by Personal
<br />Representative to herself as Trustee pursuant to the terms of the
<br />Last Will & Testament of Johanna Opp dated August 17, 1983, for the
<br />benefit of Robert Opp.
<br />3. The Last Will & Testament of Johanna Opp dated August 17,
<br />1983, provided in part, the following provision:
<br />THIRD: In the event my husband, CHRISTIAN G. OPP, shall
<br />predecease me, or in the event we shall die in a common accident or
<br />disaster under such circumstances as to render it difficult or
<br />impossible to determine who predeceased the other, then I do hereby
<br />make the following disposition of my property:
<br />A. I hereby give and devise my real estate legally described
<br />as follows:
<br />the West Half of the Southwest Quarter (W36Sw %) of Section
<br />Twenty -six (26), Township Ten (10) North, Range Eleven
<br />(11), West of the 6`" P.M., Hall County, Nebraska
<br />to DARLENE WINTER, as Trustee under the following terms
<br />and conditions:
<br />(1) My Trustee shall pay over the annual net income
<br />from said trust property in at least annual
<br />installments to my son, ROBERT OPP, for and during
<br />his natural life. Upon the death of my son, ROBERT
<br />OPP, this trust shall terminate and my Trustee, or
<br />hpr P1=egSnr, 917a21. HiGtrib;7te the h�Ian ^p of
<br />trust property then being held by said Trustee to
<br />my daughter, DARLENE WINTER, absolutely and
<br />unconditionally, or if she then is deceased, the
<br />balance of the trust property shall be distributed
<br />to the descendants of Darlene Winter living at the
<br />time of the death of my son, ROBERT OPP, they to
<br />take by right of representation.
