ILndyui,l PC., I,LO. <br />9712 West Bodge Road, Suite 260 <br />Omaha, NF 68114-3419 <br />-- - - - - -- -Space Above This Line for Recording Information--- - - - - -- <br />MASTER COMMISSIONER'S DEED <br />KNOW ALL MEN BY THESE PRESENTS: <br />THAT WHEREAS, in an action found at Case No. Cl 01 -581 in the District Court <br />of Hall County, Nebraska, wherein Manufacturers & Traders Trust Company, One M & <br />T Plaza, Buffalo, New York, 14203 -2399, Trustee for Securitization Series 1999 -3, <br />Agreement dated 6- 01 -99, by and through its loan servicing agent, Fairbanks Capital <br />Corp. ( "Manufacturers & Traders "), is the plaintiff, and Charles E. Leach and Dianna J. <br />Leach, are the defendants, Manufacturers & Traders did obtain a Decree finding that <br />there is due the plaintiff the sum of Thirty -Eight Thousand Eleven Dollars and <br />Seventeen Cents ($38,011.17), plus interest, escrow advances, title search costs and <br />costs of suit; and <br />WHEREAS, it was further ordered in said Decree that in default of the payment <br />of the sum so found due by the defendants, that the appointed Master Commissioner <br />should cause the lands and tenements hereinafter described to be advertised and sold <br />according to law to pay the same; and <br />WHEREAS, default in payment having been made therein, Rachel A. Daugherty, <br />Master Commissioner under and by virtue of the said Decree and the Order of Sale to him <br />duly directed, did on June 25, 2002, inside the front door of the Hall County Courthouse, in <br />the City of Grand Island, Hall County, Nebraska, having first given due and legal notice of <br />the time and place of said sale by publication once in each week for four consecutive <br />weeks in a newspaper printed and in general circulation in said County of Hall, sell said <br />premises at public auction to Manufacturers & Traders for the sum of Thirty-Eight <br />Thousand Nine Hundred Dollars ($38,900.00); and <br />WHEREAS such Master Commissioner's sale was afterward confirmed on August <br />26, 2002, and the said Rachel A.
