200208608 <br />ADDENDUM TO AGREEMENT TO PROTECTIVE COVENANTS, <br />RESTRICTIONS AND CONDITIONS FOR <br />RAINBOW LAKE SUBDIVISION, <br />RAINBOW LAKE SECOND SUBDIVISION, <br />RAINBOW LAKE THIRD SUBDIVISION, AND <br />RAINBOW LAKE FOURTH SUBDIVISION <br />IN HALL COUNTY, NEBRASKA, AND <br />TERMINATION OF PROTECTIVE COVENANTS, RESTRICTIONS, <br />AND CONDITIONS FOR RAINBOW LAKE SUBDIVISION <br />IN HALL COUNTY, NEBRASKA, RECORDED AS <br />DOCUMENT NO. 78- 005761 IN THE OFFICE OF THE <br />REGISTER OF DEEDS OF HALL COUNTY, NEBRASKA <br />WHEREAS, Lanny D. Thomsen and Susan Andrews Thomsen, formerly known <br />as Susan L. Andrews, husband and wife, were owners of Lots Thirteen (13) and <br />Fourteen (14), Rainbow Lake Third Subdivision, Hall County, Nebraska, and <br />WHEREAS, Scott E. Fox and Laura A. Fox, husband and wife, were owners of <br />Lot 12, Rainbow Lake Third Subdivision, Hall County, Nebraska, and <br />WHEREAS, Lanny D. Thomsen and Susan Andrews Thomsen, formerly known <br />as Susan L. Andrews, husband and wife, and Scott E. Fox and Laura A. Fox, husband <br />and wife, formed and recorded a new subdivision, being Rainbow Lake Fifth <br />Subdivision, Hall County, Nebraska, which transforms Lots Twelve (12), Thirteen (13), <br />and Fourteen (14), Rainbow Lake Third Subdivision, into two lots, being Lots One (1) <br />and Two (2), Rainbow Lake Fifth Subdivision, Hall County, Nebraska, whereby Lot One <br />(1), Rainbow Lake Fifth Subdivision is owned by Lanny D. Thomsen and Susan <br />Andrews Thomsen, formerly known as Susan L. Andrews, husband and wife, and Lot <br />Two (2), Rainbow Lake Fifth Subdivision, Hall County, Nebraska, is owned by Scott <br />E. Fox and Laura A. Fox, husband and wife; and <br />WHEREAS, Lanny D. Thomsen and Susan Andrews Thomsen, formerly known <br />as Susan L. Andrews, husband and wife, and Scott E. Fox and Laura A. Fox, husband <br />and wife, previously executed the Agreement for Protective Covenants, Restrictions, <br />and Conditions concerning Rainbow Lake Subdivision, Rainbow Lake Second <br />Subdivision, Rainbow Lake Third Subdivision, and Rainbow Lake Fourth Subdivision, <br />Hall County, Nebraska, pertaining to Lots Twelve (12), Thirteen (13), and Fourteen <br />(14), Rainbow Lake Third Subdivision, Hall County, Nebraska, and before that <br />agreement was recorded in the Office of the Register of Deeds of Hall County, <br />Nebraska, the Fifth Rainbow Lake Subdivision was platted and recorded in the Office <br />of the Register of Deeds on the 22 day of July 2002, as Document No. 02- 00207603; <br />NOW, THEREFORE, the owners of Rainbow Lake Fifth Subdivision, Hall County, <br />Nebraska, stipulate and agree that Lots One (1) and Two (2), Rainbow Lake Fifth <br />Subdivision, Hall County, Nebraska, shall be subject to the protective covenants, <br />restrictions, and conditions set forth in the Agreement for Protective Covenants, <br />Restrictions, and Conditions for Rainbow Lake Subdivision, Rainbow Lake Second <br />Subdivision, Rainbow Lake Third Subdivision, and Rainbow Lake Fourth Subdivision, <br />in Hall County, Nebraska, attached to this Addendum, and hereby agree that any <br />purchaser or purchasers, their heirs, successors, personal representatives, and assigns <br />shall be bound by said Agreement, and Lots 1 and 2, Rainbow Lake Fifth Subdivision, <br />Hall County, Nebraska, are subject to the protective covenants, restrictions, and <br />conditions and shall run with the land and are set forth in the attached Agreement for <br />Protective Covenants, Restrictions and Conditions. <br />
