The undersigned, being first duly sworn on oath, deposes and states as follows: <br />1. That on or about April 30, 1990, executed and delivered to Joseph B. Sullivan a Promissory Note <br />(Note) in the original principal amount of 52,750.00 which Note is secured by, among other things; a <br />Decd of Trust dated April 30, 1990, and recorded on May 1, 1990, in Hall County, as <br />Instrument No. 90- 102367, covering the real property described as follows: <br />Lot 3, Block 1, West Bel Air Addition to the City of Grand Island, Hall County, Nebraska <br />2. Commercial Federal Bank, a Federal Savings Bank mistakenly and without consideration executed a <br />Deed of Reconveyance which was recorded at Hall County, on January 15, 2002, as Book Page <br />, Instrument No. 0200200527. <br />3. Upon diligent investigation, the undersigned has determined that the execution of the above referenced <br />Deed of Reconveyance was accomplished through a clerical error, was a mistake, and was made <br />without consideration. The undersigned also has determined that the Note was g t Daid in full, there <br />remains a balance due and owing, and the Deed of Trust is not satisfied. <br />4. This Affidavit is made for purposes of providing notice to all who may inquire that the Deed of <br />Reconveyance referenced above is erroneous, void and ineffective, and that the Deed of Trust <br />recorded on April 30, 1990, in Hall County, as Instrument No. 90- 102367 is and should be considered <br />by all to still be in full force and effect. <br />5. 1 have personal knowledge of the facts set forth above. <br />FURTHER AFFIANTOAYETH NOT.
