DEED OF TRUST MODIFICATION AGREEMENT'
<br />THIS AGREEMENT made on July Lam, 2002, between DAVID E. LOEFFLER _ h
<br />and SHARMOND R. LOEFFLER, husband and wife, jointly and severally, 14570 South
<br />190th Road, Wood River, Nebraska 68883, referred to as "TRUSTOR "; and HERITAGE
<br />BANK, 110 East 9th Street, P. O. Box 487, Wood River, Nebraska 68883, referred to
<br />as "BENEFICIARY ".
<br />The parties recite that:
<br />A. Beneficiary is the owner and holder of a certain Note dated October
<br />27, 2001 secured by a Deed of Trust of even date recorded in the
<br />original sum of $120,000.00 in the Office of the Register of Deeds, Hall
<br />County, Nebraska, as Document No. 200111203 recorded on
<br />November 2, 2002.
<br />B. The principal sum owinq on the Note and the Deed of Trust is $120.000.00.
<br />C. The parties hereto desire to modify the terms of the stated Note and
<br />Deed of Trust to include a provision for advances or readvances of
<br />$30,000.00 and Beneficiary now intends to make that advance or
<br />readvance.
<br />For the reasons set forth above and in consideration of the mutual convenants
<br />and promises of the parties, Trustor and Beneficiary convenant and agree as follows:
<br />1. FUTURE OBLIGATIONS AND ADVANCES. In addition to the unpaid
<br />balance of $120,000.00 now owing on the original Note or above mentioned obligation,
<br />the above stated Deed of Trust shall also secure all further loans or indebtedness owed
<br />or to be owed by Trustor to Beneficiary. It is stipulated that the maximum amount of
<br />additional indebtedness that under any contingency may be secured by the Beneficiary
<br />at any time in the future by reason of this agreement shall be $150,000.00. The making
<br />of such further or future advances or readvances shall be at Beneficiary's options. The
<br />advances or readvances may be made under the provisions hereof to the present
<br />Trustor,
<br />2. PRESENT ADVANCE BY BENEFICIARY. Beneficiary, pursuant to the
<br />provisions of the Note and Deed of Trust as herein modified, advances or readvances
<br />the sum of $150,000.00 on the Deed of Trust raising the amount now unpaid thereon to
<br />the total principal sum of $150,000.00 which total sum does not exceed the original
<br />amount of the Deed of Trust as herein modified.
<br />3. PAYMENT BY TRUSTOR. In consideration of such advance or readvance,
<br />receipt of which is acknowledged, Trustor, jointly and severally, hereby covenants to
<br />repay the total principal sum of $150,000.00 now owing on the Deed of Trust pursuant
<br />to the terms of the Note which is also modified to provide for payment of principal and
<br />interest on the amount due pursuant to the terms of said Note.
