SUBORDINATION AGREEMENT (Deed of Trust) 200207314 This Subordination Agreement ( "Agreement') is made this 15th day of May, 2002 by and between Wells Fargo Bank Nebraska, National Association, a national banking association ( "Wells Fargo Bank ") and James P. Zana and Joy Y. Zana (the "Creditor /Beneficiary"). RECITALS James Scott Zana and Reba Gail Stafford Zana (the "Borrower /Debtor"), gave a deed of trust to the Creditor /Beneficiary, dated July 21, 1995, and recorded in the Office of the Register of Deeds for Hall County, Nebraska on July 21, 1995 as Document Number 95- 104861 (the "Creditor Deed of Trust'), which constitutes a lien on real property located in Hall County, Nebraska more particularly described herein below (the "Property "): Second Amended Lot One (1), Block Nine (9), Continental Gardens Subdivision, City of Grand Island, Hall County, Nebraska. Wells Fargo Bank has now made or shall make a loan to benefit the Borrower /Debtor also secured by a deed of trust on the Property, dated May 15, 2002, and recorded in the Office of the Register of Deeds for Hall County, Nebraska on May 16, 2002, as Document Number 200205270 (the "Wells Fargo Bank Deed of Trust "). Creditor /Beneficiary has agreed to execute and deliver this Agreement for the purpose of subordinating its interest in the Property pursuant to the Creditor Deed of Trust to the interest of Wells Fargo Bank in the Property pursuant to the Wells Fargo Bank Decd of Trust. AGRFEMENT NOW, THEREFORE, in consideration of the premises and as an inducement to Wells Fargo Bank to accept the Wells Fargo Bank Deed of 17ust, Wells Fargo Bank and Creditor /Beneficiary agree as follows: L Creditor /Beneficiary agreed to subordinate, and hereby does subordinate, the lien of the Creditor Deed of Trust in and against the Property to the lien of the Noiwest Deed of Trust in and against the Property.
