SUBORDINATION AGREEMENT <br />(Deed of Trust) 200207314 <br />This Subordination Agreement ( "Agreement') is made this 15th day of May, 2002 <br />by and between Wells Fargo Bank Nebraska, National Association, a national banking <br />association ( "Wells Fargo Bank ") and James P. Zana and Joy Y. Zana (the <br />"Creditor /Beneficiary"). <br />RECITALS <br />James Scott Zana and Reba Gail Stafford Zana (the "Borrower /Debtor"), gave a <br />deed of trust to the Creditor /Beneficiary, dated July 21, 1995, and recorded in the Office <br />of the Register of Deeds for Hall County, Nebraska on July 21, 1995 as Document <br />Number 95- 104861 (the "Creditor Deed of Trust'), which constitutes a lien on real <br />property located in Hall County, Nebraska more particularly described herein below <br />(the "Property "): <br />Second Amended Lot One (1), Block Nine (9), Continental Gardens <br />Subdivision, City of Grand Island, Hall County, Nebraska. <br />Wells Fargo Bank has now made or shall make a loan to benefit the <br />Borrower /Debtor also secured by a deed of trust on the Property, dated May 15, 2002, <br />and recorded in the Office of the Register of Deeds for Hall County, Nebraska on May <br />16, 2002, as Document Number 200205270 (the "Wells Fargo Bank Deed of Trust "). <br />Creditor /Beneficiary has agreed to execute and deliver this Agreement for the <br />purpose of subordinating its interest in the Property pursuant to the Creditor Deed of <br />Trust to the interest of Wells Fargo Bank in the Property pursuant to the Wells Fargo <br />Bank Decd of Trust. <br />AGRFEMENT <br />NOW, THEREFORE, in consideration of the premises and as an inducement to <br />Wells Fargo Bank to accept the Wells Fargo Bank Deed of 17ust, Wells Fargo Bank and <br />Creditor /Beneficiary agree as follows: <br />L Creditor /Beneficiary agreed to subordinate, and hereby does subordinate, the lien <br />of the Creditor Deed of Trust in and against the Property to the lien of the Noiwest <br />Deed of Trust in and against the Property. Creditor /Beneficiary agrees that the <br />Wells Fargo Bank Deed of Trust shall have the same validity, force and effect as if <br />
