SECOND AMENDMENT 200207260 <br />TO DECLARATION <br />The undersigned, being the owners of more than 66 2/3% of Lots Nine (9) <br />through Twenty -three (23), both inclusive, in the Grand West Subdivision to the City of <br />Grand Island, Nebraska, which land is subject to that certain Declaration dated January <br />11, 2001 and filed as Instrument Number 200100366 in the office of the Register of <br />Deeds of Hall County, Nebraska, as amended by First Amendment to Declaration dated <br />November 13, 2001 and filed as Instrument No. 200200565 in the office of the Register <br />of Deeds of Hall County, Nebraska, do hereby approve and adopt this Second <br />Amendment to Declaration. <br />1. Property Subject to Declaration. That property subject to said Declaration as <br />amended shall consist of Lots Fourteen (14) through Twenty -three (23), both <br />inclusive, Grand West Subdivision to the City of Grand Island, Hall County, <br />Nebraska. <br />Lots Nine (9) through Thirteen (13), both inclusive, Grand West Subdivision <br />to the City of Grand Island, Hall County, Nebraska, are no longer subject to or <br />bound by the easements, restrictions, covenants and conditions of said <br />declaration as amended. <br />2. Article VIII, Section 5 of said Declaration, as amended, is hereby deleted in <br />its entirety. <br />All provisions of said Declaration, as amended, and not specifically amended herein <br />are ratified, approved and remain in full force and effect. <br />Dated March, 2002. <br />GRAND WEST, LLC <br />By: <br />Steven D.
