UTILITY EASEMENT
<br />ROBERT K. MCFARLAND and KATHLEEN L. MCFARLAND, husband and wife,
<br />herein called Grantor, in consideration of the sum of One Dollar (51.00), receipt of which is
<br />hereby acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a permanent and
<br />perpetual easement and right -of -way to survey, construct, inspect, maintain, repair,
<br />replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances
<br />connected therewith, in, upon, above, along, over, across, underneath, and through a part
<br />of Lot Five (5) Paradise Lake Estates Third Subdivision, Hall County, Nebraska; the
<br />centerline being more particularly described as follows:
<br />Commencing at a point on the Northerly right -of -way line of the Burlington
<br />Northern Santa Fe Railroad, said point being three hundred ninety seven and
<br />seventeen hundredths (397.17) feet Southeasterly from the intersection of
<br />said right -of -way line and the Westerly line of Lot Five (5) Paradise Lake
<br />Estates Third Subdivision; thence Northerly, parallel with the Westerly line of
<br />said Lot Five (5), a distance of one hundred seventy eight and one tenth
<br />(178.1) feet; thence deflecting Northeasterly 19 °04'20 ", a distance of two
<br />hundred forty four and five tenths (244.5) feet to the Actual Point of
<br />Beginning; thence deflecting Northwesterly 82 °37'52 ", a distance of three
