ASSIGNMENT OF NEBRASKA DEED OF TRUST AND SECURITY AGREEMENT
<br />KNOW ALL MEN BY THESE PRESENTS: The Equitable Life Assurance Society of
<br />the United States, a New York corporation (whose principal office and mailing address is 1290
<br />Avenue of the Americas, New York, New York 10104), in consideration of $10.00 and other
<br />valuable consideration paid by U.S. Bank National Association as Custodian/Trustee (whose
<br />mailing address is c/o Lend Lease Agri- Business, Inc., 12747 Olive Boulevard, Suite 350, P.O.
<br />Box 411995, St. Louis, Missouri 63141), the receipt of which is hereby acknowledged, does
<br />hereby grant, bargain, sell, assign, and set over to U.S. Bank National Association as
<br />Custodian/Trustee, its successors and assigns, a certain mortgage, deed of trust, security
<br />deed, act of mortgage, trust deed or similar instrument ( "Mortgage ") dated December 28. 1992,
<br />executed by Frederic M. Wiseman and Lorraine E. Wiseman, husband and wife to James R.
<br />Ganz, Jr., as Trustee for The Equitable Life Assurance Society of the United States, and
<br />recorded on January 6, 1993 in the office of the Recording Officer of Hall County, Nebraska, as
<br />Document Number 93- 100062, together with all right, title, and interest to the property described
<br />in said Mortgage and together with the promissory note therein described and the money due or
<br />to become due thereon with interest and any other collateral documents securing said note.
<br />The mortgaged property is described as follows:
<br />SEE ATTACHED LEGAL DESCRIPTION.
<br />TO HAVE AND TO HOLD the same unto U.S. Bank National Association as
<br />Custodian/Trustee, its successors and assigns forever, subject only to the provisions
<br />contained in the said Mortgage.
<br />IT BEING UNDERSTOOD AND AGREED, however, that this Assignment is made
<br />without recourse to, and without covenant or warranty express or implied by, The Equitable
<br />Life Assurance Society of the United States in any event whatsoever.
