<br />HIKE /BIKE PATH EASEMENT
<br />The undersigned, GARY SCHUMACHER and BRENDA SCHUMACHER, Husband
<br />and Wife, (Grantors), in consideration of SIX HUNDRED SIXTY -TWO DOLLARS AND
<br />SEVEN CENTS ($60207) AND OTHER VALUABLE CONSIDERATION, received from the
<br />CITY OF GRAND ISLAND, NEBRASKA, a Municipal Corporation (Grantee), receipt ofwhich
<br />is hereby acknowledged, does hereby grant, bargain, sell and convey to the CITY OF GRAND
<br />ISLAND, NEBRASKA, a Municipitf Corporation (grantee), a pemtanent and perpetual easement
<br />and right- of-way to construct, operate, maintain, extend, replace, repair and remove sidewalks
<br />and hike/bike paths along the south side of the property located on the following described tract
<br />of real estate:
<br />Fourteen feet (14') within the south forty feet (40') of Lot Two (2), Adams
<br />Way Subdivision, in the City of Grand Island, Hall County, Nebraska.
<br />The Grantee's rights shall include all rights necessary for the Cull and complete use,
<br />occupation and enjoyment of the casement herein Granted, including the right to excavate and
<br />mdll ditches, to remove trees, bushes, hedges, undergrowth, and other obstructions interfering
<br />with the location, construction, inspection, repair, replacement, removal and maintenance of such
<br />sidewalks and tdke/bike paths; provided, if such construction or maintenance requires the
<br />, emoval of hard - surfacing or grassed lawns, the Grantee or its contractor agrees to restore the
<br />surface of the easement area as soon as possible to its condition prior to said construction or
<br />maintenance work.
<br />The parties hereto agree that the Grantors may continue to use the casement area herein
<br />granted for any use permitted by law that does not interfere with the operation and maintenance
<br />ofthe sidewalks and hikrJbike paths constructed therein.
